MARYLAND STATE POLICE DUI ARRESTS ON HALLOWEEN

The following persons were arrested for DWI by the Maryland State Police on Halloween, preventing them from running over children out trick or treating or crashing into other vehicles, trees or even graveyards.  

Five of the thirteen motorists arrested by the Maryland State Police on Oct. 31, 2019, were repeat DWI offenders while one teen was arrested for DWI while possessing a learner permit and without a supervising licensed driver present in the vehicle.

Washington-County-Maryland States-Attorney-CHARLES-P.-STRONG-JR.-Republican was reelected in 2018 to his fourth term.

DWI REPEAT OFFENDER: Melissa Kimberly Gregory was arrested on Jan. 13, 2008 by Hagerstown Police Officer Douglas Hay and charged with DWI.  Gregory entered into a plea deal on March 19, 2008, with the Washington County States Attorney and entered a guilty plea to DWI. THE DEAL: Gregory was given a verdict of Probation Before Judgement, fined $500 and the States Attorney agreed to suspend $300 of the fine.

In the Baltimore County District Court on Jan. 1, 2018, Yarnall pleaded guilty to DWI and was sentenced to sixty days in jail with all of the jail time suspended and zero fine, which made the arrangement one fantastic plea deal on the part of the Baltimore County States Attorney and a bad deal for the motoring public.
Shawn Martin Yarnall was arrested by Maryland State Trooper Barry for DWI on Dec. 19, 2014, and in a plea deal on May 4, 2015, in District Court for Carroll County, picked up a verdict of Probation Before Judgement with no time and no fine.

THE DEAL: In an amazing example of being a tough prosecutor, States Attorney Covington exacted a heavy price for the crime of endangering the public on the part of Kennedy by mandating a sentence of six months and seven days in jail and then suspended six months of the sentence, leaving seven days for Kennedy to reside in the Charles County Jail.
ROBERT KENNEDY was arrested by Maryland Trooper T. Davis for DWI on Rt. 301 in Waldorf, Md., on March 7, 2015, for DWI. In a plea deal with Charles County States Attorney Tony Covington, Kennedy entered a guilty plea on Oct. 1, 2015. THE DEAL: A verdict of Probation Before Judgement with a fine of $500 and zero jail time.

You missed those who may have had their records expunged. Many times in a plea deal, it is to give them their “second chance”, so their record is clean to start over.  With a PBJ or a small fine to balance the state budget, it is wonderful that all of these depraved people with a disease can get a second chance. What’s missing in this story is how many victims of these DUI drivers get a second chance.

Nice work.   Too bad you can’t shame the judges and prosecutors to get serious.    Judges can make clear to prosecutors what limits exist on their discretion….if the prosecutors balk, the judges can make their lives hell.
