RAPE CHARGED: Isle of Wight Sheriff Captain Julian Evans indicted on charges of rape of a mentally incapacitated victim

ISLE OF WIGHT, VA. – Virginia State Police report that on March 9, 2020,  an Isle of Wight County grand jury indicted Isle of Wight Sheriff’s Captain Julian D. Evans in reference to an investigation which began in 2019 by the Virginia State Police Bureau of Criminal Investigations.

Capt. Evans, 50, from the Town of Smithfield, Va., was charged with one count of rape, with the victim having mental incapacity or helplessness.

Evans was arrested and taken to the Western Tidewater Regional Jail, where he was being held without bond pending a bond hearing.  The Sussex County Commonwealth’s Attorney’s Office was appointed on Oct. 3, 2019, according to court records, to serve as a special prosecutor for this matter. 

Court records show that representing Evans in the charge of Rape of Helpless Victim is attorney Timothy G. Clancy with a court hearing in Isle of Wight Circuit Court for bail held on March 10, 2020, which resulted in his release from the Western Tidewater Regional Jail.  An arraignment hearing has been set for April 13, 2020, in Isle of Wight Circuit Court.

Court records show that the offense date was Aug. 19, 2019. The appointment of a special prosecutor from another county in Virginia is typically due to close professional and or personal relationships between the defendant and the prosecutors in the Isle of Wight Commonwealth Attorney’s Office presenting a possible conflict of interest.

The Isle of Wight Sheriff’s Department has Capt. Evans listed on the department website as operations commander and has not provided any comment or press release on his indictment and arrest on the website or Facebook page where the agency announced that it posts press releases.
