ARLINGTON, VIRGINIA – The world is upside down when the Governor of Virginia has ordered citizens to stay home through June 10, 2020 and the police arrest the victim of a crime instead of the perpetrators. That is exactly what happened in Arlington County, Virginia.

The Arlington County Police Department’s Homicide/Robbery Unit reported that it is investigating a shooting that took place in the Green Valley neighborhood on the morning of March 29, 2020.

At approximately 4:53 a.m., police were dispatched to the report of trouble unknown in 2428 Shirlington Road. The preliminary investigation indicates that three subjects forced entry into the Arlington Smoke Shop and began stealing cash and merchandise.  Various smoke shop stores in the region have been targeted in burglaries and robberies in recent months.

An employee inside a back room heard the break in, retrieved a firearm, opened the door to the sales floor and discharged the weapon, striking one juvenile subject.

Police say that the employee retreated to the back room but reentered the sales floor and discharged his weapon again as the subjects were attempting to flee the business.

Arriving officers located the injured juvenile subject outside the Arlington Smoke Shop. He was transported by medics to an area hospital with injuries that are considered serious but non-life threatening. The other two subjects fled the scene on foot prior to police arrival.

Owner Jowan Aqrawi told ABC7 he is outraged and feels the shooting should have been considered self-defense.

“4:30 am, three masked men entering your home where you’re asleep,” he told ABC7. “Put yourself in that position, and you’ll have a better understanding.”

Following consultation with Commonwealth’s Attorney Parisa Dehghani-Tafti, the employee, Hamzeh Abushariah, 33, of Washington D.C. was unbelievably charged with Malicious Wounding, Reckless Handling of a Firearm and Violation of a Protective Order. He is being held without bond.

Additional charges related to the breaking and entering are anticipated at a later date, according to police, meaning that the store clerk, defending the business from burglars was arrested and held without bail while two days have passed and no charges have been placed against the burglars.

One of the police officers asked the clerk why he didn’t retreat out the back door.

The election campaign in which Dehghani-Tafti beat incumbent Theo Stamos in the Democratic Primary in 2019, centered around the social justice values preached by the new prosecutor who campaigned on “exonerations” and had never prosecuted a case. She spent her time defending miscreants and worked with the Innocence Project – which actually spends a lot of energy seeking technicalities to overturn the convictions of guilty and violent criminals.

Ironically, even though Dehghani-Tafti campaigned with a promise to eliminate cash bail for defendants pending trial, the store clerk of Arlington Smoke Shop is being held on a $25,000 bail for defending himself and his employer’s business. On March 31, 2020, Hamzeh Abdelmajid Abushariah filed an appeal in Arlington County Circuit Court to have the bond reduced in order to be released from jail. A hearing is set for April 1, 2020.

Dehghani-Tafti issued this statement to ABC7: “I cannot ethically discuss an ongoing investigation because doing so would not only risk compromising our work but also unfairly impede on the rights of the accused and interfere with the investigation. Suffice it to say, there is evidence we are not at liberty to share that support the charges, the decision was not made lightly, and we ask the public not to rush to judgment on what is very much a live investigation.”
