Eric Benjamin Mitchell’s record of domestic violence ignored by Charles County Judge who allowed drug treatment instead of a secure jail cell for the attempted murder of his girlfriend; stabbed her in front of their two children

LAPLATA, MD. – There are real victims of the crusades of liberal prosecutors in Maryland in their quest to emptying jails of criminals during the current Wuhan Virus / Coronavirus / COVID Pandemic, and they are the women and children associated with the crimes of violent repeat offenders.  The following account is the true story of a ruthless and violent offender in Maryland.

Eric Benjamin Mitchell escaped from an insecure drug treatment facility in Harford County, Maryland, after a Charles County Circuit Court Judge allowed him to be sent there instead of held behind bars following the stabbing of his girlfriend. The attempted murder took place on February 9, 2020, in front of the couple’s two children in their Waldorf apartment. Charles County Sheriff Troy Berry reports that Mitchell is considered dangerous and should not be approached – yet he was allowed to be assigned to a drug counseling center. On his chest is inscribed the words, “Only God Can Judge,” reports police in the announcement to the public to assist in his apprehension.

Court records show that Mitchell stabbed his girlfriend in front of the couple’s two children as she attempted to flee his assault in their Waldorf apartment. The woman told investigators that Mitchell was smoking joints laced and dipped in PCP for several days when he began to assault her. Mitchell was apprehended with Patrol Officer Will Levy responded to the 911 call at the Gallery Place residence. Officer Levy said in his charging documents that Mitchell was standing in the apartment, which had the door wide open and appeared to be dazed. The female victim of Mitchell was found in a neighbor’s apartment bleeding profusely. Medics stemmed the flow of the bleeding in time for her to be taken first to Charles Regional Hospital in LaPlata and then flown by helicopter to Medstar. 

The victim knew that Mitchell had been using PCP for several days, according to court records. And her failure to protect her children from living in the dangerous household could result in child protective services removing them from her custody or putting her under strict supervision at such time she recovers from her wounds. Before stabbing her, Mitchell hit her several times with an open hand, the victim told police, as she fled with their children, ages one and two years of age. When arrested, Mitchell had a considerable amount of blood on him and no injuries of his own to account for the blood. Officers found PCP and pot in the apartment and report that Mitchell said he hid the knife in a kitchen cabinet.  Police arrest records reflect that Mitchell admitted to smoking the PCP for several days before the attack on the mother of his children, which resulted in the laceration of her liver.

Eric Benjamin Mitchell, (DOB 11/13/1997) of 3008 Gallery Place Apt. T-5, Waldorf, Md., was ordered in 2019 to stay away from the victim in a domestic violence case in Prince George’s County, according to court records.  A Prince George’s County District Court Judge issued a final order on March 6, 2019, for Mitchell to surrender his firearms, participate in a domestic violence program, not contact, abuse, or enter the residence of the victim. The order was filed just one day shy of a full year before his latest indictment on attempted murder charges issued by a Charles County Circuit Court Grand Jury on February 28, 2020. Criminal charges of violating a protective order resulted in a plea deal by Prince Georges States Attorney Aisha Braveboy on October 8, 2019, when Braveboy put the charges on the Stet Docket. Mitchell spent about three weeks in jail when he was arrested in Prince George’s County before the easy deal in court. A prior offense of violating a court order in domestic violence that Mitchell ignored was also given a plea deal on November 22, 2016, by Charles County States Attorney Anthony Covington in District Court when the charge was put on the Stet Docket.

Mitchell was ordered released from the Charles County Jail to a drug treatment center on April 30, 2020, according to court records, after his commitment to the jail on February 12, 2020.  Following his escape from the drug treatment center, a judge issued a bench warrant for his arrest and for him to be held in jail without bond on July 13, 2020.

 In a plea deal with Charles County States Attorney Anthony Covington, the prosecutor missed a chance to help Mitchell get off of PCP and other drugs when he agreed on July 17, 2018, to allow him to have all of a six-month sentence suspended when Mitchell pleaded guilty to possession of heroin or PCP.

Unless Mitchell could have obtained drugs while in the Charles County Jail, which is unlikely due to the competence of Sheriff Troy Berry’s administration of the facility – Mitchell would have had a six-month vacation from ingesting drugs.  Yet another opportunity to incarcerate Mitchell went by the wayside when a Charles County District Court Judge dismissed a charge of violation of probation on December 31, 2019.

An eviction action filed on April 10, 2020, against Tianna Charmaine Ford for the couple’s apartment on Gallery Place was dismissed in Charles County District Court on June 9, 2020.  Most court actions, including evictions for non-payment of rent, have been suspended due to the Pandemic. A criminal charge of failing to obey a lawful order of a police officer against Ford is pending in Charles County District Court for trial on September 2, 2020.  Upper Marlboro attorney Jamon D. Wiggs is listed in court records as her lawyer.

The Circuit Court Indictments issued against Mitchell charged the following offenses:

• Attempted second-degree murder
• Felony first-degree assault
• Second-degree assault
• False imprisonment
• Possession of PCP

If Mitchell is captured, a hearing has been delayed until September 29, 2020.  The taxpayers of Maryland will be providing Mitchell with a free attorney, Abigail Marie Thibeault, of LaPlata to represent him. At the same time, Mitchell used his funds to secure the alleged PCP that he was dallying with for several days before stabbing his girlfriend, the mother of his children.

Mitchell was arrested by Charles County Sheriff’s Department Patrol Officer Will Levy after officers responded to the Gallery Place apartment building following an emergency 911 call placed by a neighbor who shielded the victim after she fled the apartment when Mitchell allegedly stabbed her in the stomach with a knife on February 10, 2020.

On July 17, 2020, Prince Georges County States Attorney Aisha Braveboy issued this statement as part of a press release boasting of how many accused criminals, she has sprung from jail cells:

“As a result, we safely reduced the jail population by 192 inmates since March 1, 2020, an almost 40% reduction. There were 718 inmates in the county’s detention center on March 1. As of July 1, 2020, there were 526—approximately 1/3 of the detention center’s inmate capacity—who remain in custody, most of whom are charged with violent crimes, very serious offenses, or serving out sentences. Over 1,600 individuals have been released from the detention facility to include those defendants released during their initial appearance before a Commissioner, which occurs shortly after their arrest.”
