Search Warrant Issued in Connection With Looming Charges for JULIAN ELIE KHATER, Who Allegedly Sprayed Bear Mace on Capitol Police Officer Brian Sicknick Reveals Mobster with Gun and Extended Magazine

AFFIDAVIT IN SUPPORT OF AN APPLICATION UNDER RULE 41 FOR A WARRANT TO SEARCH AND SEIZE
I, Riley Palmertree, being first duly sworn, hereby depose and state as follows:
INTRODUCTION AND AGENT BACKGROUND
I make this affidavit in support of an application under Rule 41 of the Federal Rules of Criminal Procedure for a warrant to search the premises known as 205 BLUE RIDGE LANE MORGANTOWN, WV 26508, hereinafter “PREMISES,” 708 BEECHURST AVENUE, MORGANTOWN, WV 26505, hereinafter “BUSINESS,” and 2012 WHITE JEEP GRAND
CHEROKEE WITH WEST VIRGINIA LICENSE TAG 53T507 and VIN: 1C4RJFAT2CC204303, hereinafter “VEHICLE”1 further described in Attachment A, for the things described in Attachment B.

DETAILS PINPOINT ONE OF THE RIOTERS WHO WAS ARMED WITH A HANDGUN WITH AN EXTENDED MAGAZINE

The subjects also confronted and terrorized members of Congress, Congressional staff, and the media. The subjects
carried weapons including tire irons, sledgehammers, bear spray, and tasers. They also took police equipment from overrun police including shields and police batons. At least one of the subjects carried a handgun with an extended magazine. These actions by the unknown individuals resulted in the disruption and ultimate delay of the vote Certification.

  1. Also at approximately 2:30 p.m., as subjects reached the rear door of the House
    Chamber, USCP ordered the evacuation of lawmakers, Vice President Mike Pence, and president pro tempore of the Senate, Charles Grassley, for their safety.
  2. At around 2:45 p.m., subjects broke into the office of House Speaker Nancy Pelosi.
    At about the same time, one subject was shot and killed while attempting to break into the House chamber through the broken windows.
  3. At around 2:47 p.m., subjects broke into the United States Senate Chamber.
    Publicly available video shows an individual asking, “Where are they?” as they opened up the door to the Senate Chamber. Based upon the context, law enforcement believes that the word “they” is in reference to members of Congress.

  1. The VEHICLE appears to have an expired registration and lists the owner as George TANIOS with an address of 120 Putnam Street, Morgantown, West Virginia. Your affiant believes this may have been a previous residence of TANIOS and as of March 5, 2021 appears to be vacant.
  2. Based on my training and experience and the facts as set forth in this affidavit, I
    respectfully submit that there is probable cause to believe that violations of 18 U.S.C. §§ 372,
    111(a), 111(b), 2, 231(a)(3), 1512(c)(2), 1752(a)(1), (2) & (4), (b)(1)(A), and 40 U.S.C. §
    5104(e)(2), have been committed by multiple identified and unidentified individuals. There is also probable cause to search the information described in Attachment A for evidence relating to these crimes as further described in Attachment B.

    (Civil Disorder); 18 U.S.C. § 1512(c)(2) (Obstruction of an Official Proceeding); 18 U.S.C. §
    1752(a) and (b) (Physical violence on restricted grounds, while carrying dangerous weapon, and
    resulting in significant bodily injury); 40 U.S.C. § 5104(e)(2)(F) (Violent Entry, Disorderly
    Conduct and act of physical violence on Capitol Grounds) (the “Target Offenses”) have been committed by JULIAN ELIE KHATER and GEORGE PIERRE TANIOS (“the Subjects”) and other identified and unidentified persons, including others who may have been aided and abetted by, or conspiring with, the Subjects, as well as others observed by the Subjects. There is also probable cause to search the PREMISES, BUSINESS, and VEHICLE, further described in Attachment A, for the things described in Attachment B.

In reviewing surveillance footage of this incident, your affiant observed the SUBJECTS, JULIAN ELIE KHATER and GEORGE PIERRE TANIOS, working together to assault law enforcement officers with an unknown chemical substance by spraying officers directly in the face and eyes. Your affiant further observed these SUBJECTS appeared to time the
deployment of chemical substances to coincide with other rioters’ efforts to forcibly remove the bike rack barriers that were preventing the rioters from moving closer to the Capitol building.

  1. Surveillance footage shows that at 2:09 p.m., TANIOS can be seen walking from the south grassy area toward the Lower West Terrace. KHATER can be seen walking behind TANIOS. KHATER is wearing a beanie with a pom-pom on top, a dark jacket, and has a beard. TANIOS is wearing a red hat, black backpack, dark hooded sweatshirt, and has a beard. At 2:14 p.m., TANIOS and KHATER can be seen engaging each other in animated conversation while
    they are standing together.
  2. During the investigation, law enforcement discovered open source media video of the incident from January 6, 2021. On the video, KHATER is seen making his way towards TANIOS. KHATER then states, “Give me that bear shit,” and reaches into the backpack on TANIOS’ back. TANIOS then states, “Hold on, hold on, not yet, not yet… its still early.” KHATER is then seen emphatically telling TANIOS, “They just fucking sprayed me,” and KHATER is seen holding a white can with a black top that appears to be a can of chemical spray

Injuries to Officers
Officers Sicknick, Edwards, and Chapman suffered injuries as a result of being sprayed in the face with an unknown substance by KHATER. The officers were temporarily blinded by the substance, were temporarily disabled from performing their duties, and needed medical attention and assistance from fellow officers. They were initially treated with water in an effort to wash out the unknown substance from their eyes and on their face. All three officers were incapacitated and unable to perform their duties for at least 20 minutes or longer while they recovered from the spray.
Officer Edwards reported lasting injuries underneath her eyes, including scabbing that remained on her face for weeks. Officers Edwards and Chapman also described the spray to their face as a substance as strong as, if not stronger than, any version of pepper spray they had been exposed to during their training as law enforcement officers. Officer Sicknick reported to his supervisors and colleagues that he had been sprayed in the face with a substance.

Identification of JULIAN KHATER
During the investigation, law enforcement received information from a tipster regarding subject 190. The tipster relayed that the subject was the same person who owned a Linkedin page belonging to JULIAN KHATER.
Based on a review of this Linkedin page, law enforcement identified and spoke by telephone to W-1. W-1 stated IT was a former work colleague of KHATER. Your affiant provided W-1 an image of subject 190, and W-1 positively identified the individual as “Julian” and stated IT was “100% sure” the individual was “Julian,” whom IT knew from working together at a food establishment in State College, Pennsylvania. W-1 saw KHATER approximately three to four
times per week from July 2019 to November 2019, and last saw KHATER in November 2019. W1 did not immediately remember KHATER’s last name, but looked up an old work document that listed Julian’s last name as KHATER.

FBI releases new video of the mad bomber who placed bombs the day before the Capitol Riot on Jan. 6, 2021

The FBI’s Washington Field Office has released new information and video regarding the pipe bombs placed in the Capitol Hill neighborhood of Washington, D.C., on January 5, 2021, and is seeking additional information from the public. Identifying the person responsible for placing these pipe bombs is a priority for the FBI’s Washington Field Office and our partners at the Bureau of Alcohol, Tobacco, Firearms and Explosives; U.S. Capitol Police; and D.C. Metropolitan Police Department.

On the evening before the violence at our nation’s Capitol, between 7:30 p.m. and 8:30 p.m., two pipe bombs were placed near the Democratic National Committee (DNC) headquarters and Republican National Committee (RNC) headquarters. One device was placed in an alley behind the RNC headquarters, located at 310 First Street Southeast, and the other was placed next to a park bench near the DNC headquarters, located at 430 South Capitol Street Southeast #3.

“The American people have provided invaluable assistance in this investigation, and the FBI and our law enforcement partners are very grateful for that cooperation,” said Steven M. D’Antuono, assistant director in charge of the FBI’s Washington Field Office. “We still believe there is someone out there who has information they may not have realized was significant until now. We know it can be a difficult decision to report information about family or friends—but this is about protecting human life. These pipe bombs were viable devices that could have been detonated, resulting in serious injury or death. We need the public’s help to identify the individual responsible for placing these pipe bombs to ensure they will not harm themselves or anyone else.”

The FBI has previously released photos of the individual, including of the individual’s shoes, the devices, and the kitchen timers used in hopes that someone recognizes something familiar about them. The person who placed these bombs wore a face mask, a grey hooded sweatshirt, and black and light grey Nike Air Max Speed Turf shoes with a yellow logo. They used a backpack to transport each of the devices.

The FBI is asking the public to watch the videos of this person—you may recognize their gait, body language, or mannerisms. We are asking the public to come forward with any information that could assist us, including any odd or out-of-character behavior you noticed in a family member, friend, or coworker, leading up to or after January 5. Regarding the evening of January 5, we are asking for information about an individual who you may have observed matching this description in the vicinity of North Carolina Avenue SE and Folger Park between 6:30 p.m. and 9:00 p.m.. This person may have entered a vehicle or taken an item from a vehicle and placed it into the backpack.

Together with the ATF, the FBI is offering a $100,000 reward for information leading to the identification of the person who placed these devices on the night of January 5. Man Used Fists and Helmet to Shatter Glass Panels of Door Leading to Speaker’s Lobby

            WASHINGTON, D.C. – Zachary Jordan Alam, 29, from the District of Columbia area was indicted today for assaulting, resisting, or impeding officers while using a dangerous weapon, among other charges, for his violent conduct within the U.S. Capitol building on January 6.  After entering the Capitol building unlawfully, the man punched, kicked, and using a helmet, shattered the glass panels of doors leading to the Speaker’s Lobby as others who had breached the building also sought to force their way in further.

Indictments against Zachary Jordan Alam

     Alam was indicted by a federal grand jury in the District of Columbia on 11 counts.    Two of the counts – assaulting, resisting, or impeding officers while using a dangerous weapon, and obstruction of an official proceeding – carry maximum penalties of 20 years.

     According to the indictment, Alam caused more than $1,000 worth of damage to the glass panels of the doors to the Speaker’s Lobby of the U.S. Capitol building.  It is alleged that on January 6, the doors to an area known as the Speaker’s Lobby, a hallway that connects to the House Chamber, were barricaded and guarded by three officers of the United States Capitol Police.  Video footage from inside the Capitol building shows Alam repeatedly punching the glass panels of the doors located immediately behind the officers and then kicking the glass and smashing the glass with a helmet, ultimately breaking the windows. 

     Alam was arrested and originally charged by criminal complaint on January 30, in Denver, Pennsylvania.  On February 2, United States Magistrate Judge Richard A. Lloret of the Eastern District of Pennsylvania ordered Alam detained pending his transfer to the District of Columbia for further proceedings.

Members of the crowd were shouting and gesticulating at the officers. The Subject Male is in video footage shouting “Fuck the blue” multiple times in the faces of the U.S. Capitol Police officers who were standing post outside the Speaker’s lobby door. Additional officers in riot gear arrived behind the
crowd at the Speaker’s Lobby doors, and the three officers guarding the door appeared to move to the adjacent wall.
Seconds after the officers stepped away from the doorway, the Subject Male began kicking the glass panels of the Speaker’s Lobby door. Shortly thereafter, he took a black-colored helmet from an individual with a yellow “Don’t tread on me” flag, took off his fur-lined hat and red baseball hat, and violently struck the middle glass panel repeatedly with the helmet, further shattering the window. The Subject Male then smashed the window panel on the right with the helmet. Chants could be heard of “Break it down!” and “Let’s fucking go!” Babbitt was shot while attempting to climb through one of the shattered windows. After the shot, the Subject Male backed away toward the stairwell next to the U.S. Capitol Police tactical unit. The Subject Male put the helmet on and wore it as he stood on the steps of the stairwell.

ARREST OF TRUMP APPOINTEE FEDERICO GUILLERMO KLEIN

Following the January 6, 2021, attack on the Capitol, your affiant reviewed multiple videos derived from open-source databases, as well as both Metropolitan Police Department (MPD) and U.S. Capitol Police holdings. During that review, your affiant observed a subject committing assaults on MPD and U.S. Capitol Police officers on January 6, 2021, between approximately 2:43 p.m. and 3:30 p.m., in and around the Lower West Terrace of the Capitol building. The subject, later identified as FEDERICO GUILLERMO KLEIN (KLEIN ), is a white male with brown hair and distinctive teeth who was wearing a red Make America Great Again ” (MAGA) hat, a distinctive green jacket, dark dress pants, and a blue dress shirt. KLEIN would later change into a red United States Marine Corps (USMC) hat. In the above-mentioned video footage, your affiant
observed KLEIN resisting officers, attempting to take items from officers, and assaulting officers with a riot shield.
On approximately January 20, 2021, KLEIN was included in a “ seeking information” list and given the moniker“ 136-AFO .” The FBIpostedthat list to its website and to social media in order to garner public assistance to identify the individual.

After the media bombarded Americans with this story for a full month without pause, it took center stage at Trump’s impeachment process. As former federal prosecutor Andrew McCarthy noted, the article of impeachment itself stated that “Trump supporters ‘injured and killed law enforcement personnel.’” The House impeachment managers explicitly claimed on page 28 of their pretrial memorandum that “the insurrectionists killed a Capitol Police officer by striking him in the head with a fire extinguisher.”

Once the impeachment trial ended in an acquittal, President Joe Biden issued a statement and referenced this claim in the very first paragraph. Sicknick, said the President, lost “his life while protecting the Capitol from a violent, riotous mob on January 6, 2021.”


The problem with this story is that it is false in all respects. From the start, there was almost no evidence to substantiate it. The only basis were the two original New York Times articles asserting that this happened based on the claim of anonymous law enforcement officials.

Despite this alleged brutal murder taking place in one of the most surveilled buildings on the planet, filled that day with hundreds of cellphones taping the events, nobody saw video of it. No photographs depicted it. To this day, no autopsy report has been released. No details from any official source have been provided.

Not only was there no reason to believe this happened from the start, the little that was known should have caused doubt. On the same day the Times published its two articles with the “fire extinguisher” story, ProPublica published one that should have raised serious doubts about it.

The outlet interviewed Sicknick’s brother, who said that “Sicknick had texted [the family] Wednesday night to say that while he had been pepper-sprayed, he was in good spirits.” That obviously conflicted with the Times’ story that the mob “overpowered Sicknick” and “struck him in the head with a fire extinguisher,” after which, “with a bloody gash in his head, Mr. Sicknick was rushed to the hospital and placed on life support.”

But no matter. The fire extinguisher story was now a matter of lore. Nobody could question it. And nobody did: until after a February 2 CNN article that asked why nobody has been arrested for what clearly was the most serious crime committed that day: the brutal murder of Officer Sicknick with a fire extinguisher. Though the headline gave no hint of this, the middle of the article provided evidence that essentially declared the original New York Times story false: MORE

Member of Proud Boys Charged with Obstructing an Official Proceeding, Other Charges Related to the Jan. 6 Riots

            WASHINGTON— A member of the Proud Boys, a nationalist organization, was arrested today and charged in federal court in the District of Columbia with obstructing or impeding an official proceeding, among other charges.

            Ethan Nordean, a/k/a Rufio Panman, 30, of Washington state, was charged by criminal complaint in federal court in the District of Columbia with obstructing or impeding an official proceeding, which carries a maximum penalty of 20 years in prison; aiding and abetting, which carries a maximum penalty of 10 years in prison; and knowingly entering or remaining in a restricted building or grounds and violent entry and disorderly conduct on Capitol grounds, which each carry a maximum penalty of one year in prison. Nordean will appear in federal court in the Western District of Washington at 2:00 PST.

            According to charging documents, Nordean is the self-described “Sergeant of Arms” of the Seattle Chapter of the Proud Boys, a group self-described as a “pro-Western fraternal organization for men who refuse to apologize for creating the modern world; aka Western Chauvinists.”

            It is alleged that Nordean was observed marching at the front of a group of known Proud Boys shortly before the riot began. It is further alleged that Nordean was among those who entered the U.S. Capitol building after rioters, including certain persons associated with the Proud Boys, forced entry into the Capitol by means of destruction of Federal property. It is also alleged that Nordean was near the front of the crowd of rioters, who collectively approached, confronted, and vastly outnumbered Capitol Police.

            Prior to Jan. 6, 2021, Nordean posted on social media certain indications of an intent to organize a group that intended to engage in conflict. For example, around Dec. 27, 2020, Nordean posted a message asking for donations of “protective gear” and “communications equipment.”  On Jan. 4, 2021, Nordean posted a video on social media, which he captioned, “Let them remember the day they decided to make war with us.”

            On or about the same day, Nordean posted a video of a discussion that Nordean had with another member of the Proud Boys. During the course of the hour long video, Nordean discussed what he described as “blatant, rampant voter fraud” in the Presidential election. Nordean went on to say that, rather than being complacent, the Proud Boys were going to “bring back that original spirit of 1776 of what really established the character of what America is. And it’s not complacency, it’s not low standards. It’s ‘this is how it’s going to be, and I don’t give a god damn.’” Later in the video, Nordean said, “Democracy is dead? Well, then no peace for you. No democracy, no peace.”

            The day before the riots, Nordean posted the following statement to social media: “It is apparent now more than ever, that if you are a patriot, you will be targeted and they will come after you, funny thing is that they don’t realize is, is we are coming for them. You’ve chosen your side, black and yellow teamed with red, white and blue against everyone else.”

            On Jan. 8, 2021, Nordean posted a photo on social media of a U.S. Capitol Police officer administering pepper spray on Jan. 6, 2021, with the following caption: “if you feel bad for the police, you are part of the problem. . .”

Did Officer Sicknick make a call to a family member the day after the riot and report he was okay? Did he die of a stroke and not an assault with a fire extinguisher?

WHO IS LYING AND WHY?

On Monday, Law Officer published a news story, which included video of a rioter tossing a fire extinguisher at officers, hitting one on the head. However, there has been no official confirmation this event is connected to Sicknick’s circumstances.

Moreover, the website ProPublica offered a different explanation.

It quoted Ken Sicknick, whom the site identified as the late officer’s brother, as saying that Brian Sicknick had communicated with his family and never mentioned a fire extinguisher attack.

“He texted me last night and said, ‘I got pepper-sprayed twice,’ and he was in good shape,” said Ken Sicknick. “Apparently he collapsed in the Capitol and they resuscitated him using CPR.”

The site said that on Thursday, family members were told that the officer had a blood clot and suffered a stroke and was on a ventilator.

“We weren’t expecting it,” Ken Sicknick said.

Ken Sicknick offered his own explanation for his brother’s death, The Western Journal reported.

He spent his life trying to help other people,” he said. “This political climate got my brother killed.” MORE

Statement from U.S. Capitol Police on No-Confidence Vote

February 10, 2021 

A vote of no confidence is expected this week regarding multiple U.S. Capitol Police Department officials, including Acting Chief Yogananda Pittman. Though the vote does not compel any specific action, it does speak to the sentiment and concerns of some of our officers that our senior commanders are working to address. We do appreciate the letters of support we have received from the immediate past president of our fraternal order of police as well as the local Teamsters union.

Since the appointment of Acting Chief Pittman two days after the attack, she and her executive team took quick action to improve intelligence and operational communications with all officers. The team is also offering counseling and wellness support to all Department employees, including family members given the emotional toll so many are experiencing.

The events of January 6 were tragic and heartbreaking. Two of our own died and others were subjected to inexcusable violence during the attack. Since her appointment on January 8, Acting Chief Pittman has met with officers from every division and has grieved with the families and loved ones of our fallen. 

The entire USCP continues to work diligently to see to it that what happened on January 6 will never happen again, and that all officers will have the tools and resources they need, both personally and professionally. Much work remains, but we are moving swiftly to help each other heal and build on our collective successes.

Three Individuals Affiliated With the Oath Keepers Indicted in Federal Court for Conspiracy to Obstruct Congress on Jan. 6, 2021

Three individuals associated with the Oath Keepers, a paramilitary organization focused on recruitment of current and former military, law enforcement, and first responder personnel, were indicted today in federal court in the District of Columbia for conspiring to obstruct Congress, among other charges.

Jessica Marie Watkins, 38, and Donovan Ray Crowl, 50, both of Champaign County, Ohio; and Thomas Caldwell, 65, of Clarke County, Virginia, were indicted today in federal court in the District of Columbia on charges of conspiracy, obstructing an official proceeding, destruction of government property, and unlawful entry on restricted building or grounds, in violation of 18 U.S.C. §§ 371, 1512, 1361, and 1752. Watkins and Crowl were arrested on Jan. 18; Caldwell was arrested on Jan. 19. All three individuals originally were charged by criminal complaint. The maximum penalty for Obstructing an Official Proceeding is a sentence of up to 20 years in prison.

According to the charging documents, Watkins, Crowl, and Caldwell communicated with each another in advance of the Jan. 6, 2021, incursion on the U.S. Capitol and coordinated their attack. Watkins, Crowl, and Caldwell are all affiliated with the Oath Keepers, while Watkins and Crowl are also members of the Ohio State Regular Militia. Watkins claimed to be a commanding officer within the Ohio State Regular Militia in a social media post.

According to the indictment, the three defendants initiated their communications and coordination in November 2020 and continued through on or about Jan. 19, 2021, when Caldwell was arrested. The exchanges vary in topics from a call to action to logistics, including lodging options, coordinating calls to discuss the plan, and joining forces with other Oath Keeper chapters. On Dec. 31, 2020, Caldwell posted, “THIS IS OUR CALL TO ACTION, FREINDS! SEE YOU ON THE 6TH IN WASHINGTON, D.C. ALONG WITH 2 MILLION OTHER LIKE-MINDED PATRIOTS.” In a subsequent post on Jan. 2, 2021, Caldwell stated, “It begins for real Jan 5 and 6 on Washington D.C. when we mobilize in the streets. Let them try to certify some crud on capitol hill with a million or more patriots in the streets. This kettle is set to boil…”

As alleged in the indictment, in one transmission Watkins stated, “We have a good group. We have about 30-40 of us. We are sticking together and sticking to the plan.” An unknown male responds, “We’ll see you soon, Jess. Airborne.”

According to the criminal complaint filed on Jan. 19, on Jan. 6, the three documented their participation and whereabouts in or around the U.S. Capitol on social media. Caldwell posted messages on Facebook such as, “We are surging forward.  Doors breached[.]” and at 3:05 p.m. posted just, “Inside.” Watkins posted photos of herself, and with Crowl, on her Parler account and captioned a photo by stating, “Me before forcing entry into the Capitol Building. #stopthesteal2 #stormthecapitol #oathkeepers #ohiomilitia.” Subsequently, she posted a video of herself inside the Capitol captioned, “Yeah. We stormed the Capitol today. Teargassed, the whole, 9. Pushed our way into the Rotunda. Made it into the Senate even. The news is lying (even Fox) about the Historical Events we created today.”

In addition to the communication via Facebook and Parler, the FBI obtained an audio recording of Zello communications between Watkins and other suspected Oath Keepers during the Capitol incursion on a channel called “Stop the Steal J6.” As alleged in the indictment, in one transmission Watkins stated, “We have a good group. We have about 30-40 of us. We are sticking together and sticking to the plan.” An unknown male responds, “We’ll see you soon, Jess. Airborne.” Following the U.S. Capitol incursion, Watkins and Crowl each interviewed with the media. During the interviews, both confirmed membership of the Oath Keepers.

The case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia and the National Security Division, Counterterrorism Section, Department of Justice. Valuable assistance was provided by the U.S. Attorneys’ Offices for the Southern District of Ohio and Western District of Virginia. The case is being investigated by the FBI’s Washington Field Office and the Cincinnati Division, Dayton Joint Terrorism Task Force, with assistance by the FBI’s Richmond Division.

DOUGLAS AUSTIN JENSEN (JENSEN) of Des Moines, Iowa, traveled to the District of Columbia to participate in a rally and protest at the U.S. Capitol. JENSEN is an adherent of “QAnon,” also known as “Q,” and wore a “Q” t-shirt to the protest. JENSEN was among the first members of the crowd to push his way inside the United States Capitol and, in doing so, he refused
multiple orders by a uniformed Capitol Police officer to stop, place his hands up, and back up.
Video footage from January 6, 2021, which has since been published by The Guardian—an international news media company, shows JENSEN leading a crowd of followers inside the United States Capitol.
As the crowd moved forward, a lone Capitol Police officer ordered JENSEN to stop and put his hands up. Rather than comply with the order, JENSEN led the crowd toward the officer in a menacing manner, causing the officer to retreat and repeat his commands. JENSEN continued to lead the crowd toward the officer. When the retreating officer reached a staircase, the officer turned and ran up a flight of stairs in an attempt to get to back up. The video footage captures JENSEN chasing the officer up the stairs and shouting at the officer. Twice more, the officer orders JENSEN to stop and raises his hand to keep JENSEN from advancing. Both times JENSEN continued to advance in a menacing manner, with the crowd following behind him, forcing the officer to continue to retreat. The officer was able to retreat to an area occupied by several additional Capitol Police officers, at which point the officers were able to stop JENSEN and the rest of the crowd from advancing.

On January 14, 2021, the FBI received a call that members of the Metropolitan Police Department (MPD) were with an individual who had contacted police and wanted to turn himself in regarding a wanted poster that included a picture of him. Special Agent James Mulvihill and I responded to the 800 block of Florida Avenue, Northeast, Washington, D.C., and were met by MPD Officers of the Fifth District and VITALI GOSSJANKOWSKI. GOSSJANKOWSKI was not handcuffed or under arrest. With the assistance of MPD Officer Ulrich, from the Special Liaison Branch, GOSSJANKOWSKI was interviewed. GOSSJANKOWSKI stated that someone had called him to inform him that they had seen him on FBI wanted posters. GOSSJANKOWSKI said he never went inside of the building and that he went to the U.S. Capitol out of curiosity.
GOSSJANKOWSKI admitted to possessing a Taser, but said he found it on the ground when he was walking up towards the U.S. Capitol. GOSSJANKOWSKI stated that he left after he could not gain entrance to the U.S. Capitol and that he discarded the Taser in a trashcan outside the U.S. Capitol building. GOSSJANKOWSKI stated that he had gone to the U.S. Capitol with a friend of his from Frederick, Maryland. GOSSJANKOWSKI agreed to be photographed on January 14, 2021, Figure Seven shows how he appeared when he was interviewed. Notably, he was wearing what appeared to be the same blue jacket that Person 1 was wearing on January 6, 2021.

Dominic Pezzola Arrested and Charged with Destroying Property and Obstruction of Congressional Proceedings

            (Updated on January 16, 2021) – WASHINGTON, D.C. – A New York State man was taken into custody and charged today with unlawful entry, destruction of government property, and obstruction of an official proceeding., according to the U.S. Attorney for the District of Columbia. 

            Dominic Pezzola, 43, also known as “Spaz” and “Spazzo,” of Rochester, New York, was charged by criminal complaint with one count of obstruction of an official proceeding, in violation of Title 18, United States Code, Section 1512(c)(2); one count of destruction of government property, in violation of Title 18, United States Code, Section 1361; and one count of knowingly entering or remaining in any restricted building or grounds without lawful authority, in violation of Title 18, United States Code, Section1752(a).  Following a hearing in the Western District of New York, Pezzola was ordered detained.

            The affidavit in support of criminal complaint alleges that Pezzola unlawfully gained entry to the U.S. Capitol on January 6, 2021, by breaking a window in the U.S. Capitol with a U.S. Capitol Police shield, as an individual in the crowd yelled “Go Go Go,” before entering the Capitol building. 

            The affidavit also alleges that a video posted from inside the Capitol shows Pezzola smoking a cigar inside the building.  In that video, Pezzola can be heard saying words to the effect of, “Victory smoke in the Capitol, boys.  This is f***ing awesome.  I knew we could take this mother***er over [if we] just tried hard enough.” 

            The affidavit alleges that Pezzola was photographed in December 2020, at rallies in Washington, D.C., that included individuals wearing clothing consistent with the “Proud Boys.”

            At some point after the incident at the Capitol had ended, the affidavit in support of criminal complaint alleges, Pezzola bragged about breaking the windows to the Capitol with a Capitol Police shield.  The affidavit also alleges that Pezzola and others stated that they would have killed anyone they got their hands on, including Speaker of the House Nancy Pelosi and Vice President Michael Pence.  The affidavit alleges that, in the days after the event, members of the group said that the group would return to Washington, D.C., and kill every single “m-fer” they could. 

            A criminal complaint is a formal accusation of criminal conduct for purposes of establishing probable cause, not evidence of guilt. A defendant is presumed innocent unless proven guilty.

Hunter Allen Ehmke Arrested and Charged on Federal Charges Following Events at The United States Capitol

            (Updated on January 16, 2021) WASHINGTON, D.C. – A California man was arrested and charged yesterday in connection with the riots at the U.S. Capitol on Wednesday, January 6, 2021.

Statement of Facts

            Hunter Allen Ehmke, 20, of Glendora, California, was charged by criminal complaint with one count of obstruction of an official proceeding, in violation of Title 18, United States Code, Section 1521(c)(2); one count of violent entry and disorderly conduct on Capitol grounds, in violation of Title 40, United States Code, Section 5104(e)(2); and one count of destruction of government property, in violation of Title 18, United States Code, Section 1361.  The defendant was arrested outside of Los Angeles and made his initial appearance yesterday before Magistrate Judge John E. McDermott of the United States District Court for the Central District of California.

The mob forced Capitol Police to release Hunter Allen Ehmke from custody after he broke out windows to allow invaders to enter

            The affidavit in support of the criminal complaint alleges that during the events at the U.S. Capitol on January 6, 2021, Ehmke jumped onto a window ledge and smashed several panes out of a six-pane window that led to an office space inside the Capitol.  Officers with the United States Capitol Police were able to apprehend Ehmke on the scene.  While the officers were in the process of placing Ehmke under arrest, the large crowd became very aggressive and menacing towards the officers and, faced with being outnumbered by a threatening crowd and having no realistic way to make a safe arrest, the officers made the decision to release the defendant, ordering him to leave the Capitol grounds.  

The Architect of the Capitol estimated the damage to the window in excess of $2,400.

At approximately 2:15 p.m., Capitol Police Officer Fluke was actively holding a Civil Disturbance Unit (”CDU”) line with other officers with the United States Capitol Police on the outside of the Rotunda Door on the East side on First Street, Southeast. Your affiant has spoken to Officer Fluke about this incident and has also reviewed photos and reports of this incident described herein.

While holding back hundreds of subjects from reaching the door using CDU shields, Officer Fluke looked to the north of the Rotunda steps landing and observed an individual, later identified as Hunter Ehmke (hereinafter “Ehmke”), wearing a dark grey jacket and dark-colored pants, standing on a ledge approximately 3 feet off the ground. Officer Fluke, who is familiar with the U.S. Capitol Building from his employment with the Capitol Police knew that the ledge had access to a multiple-pane window over 6 feet in height that leads to the interior office of the building.

Officer Fluke observed Ehmke pointing towards the window, followed by looking at the crowd to his south and waving his hand as if to summon others over to his position. Ehmke repeated the sequence of gestures again. Officer Fluke shouted out, “They’re going to break the window” during this time in hopes to bring attention from fellow officers.

Officer Fluke looked east to focus back on the crowd pushing on the shields and gave orders for the growing crowd to get back. Officer Fluke turned to look north again and observed Ehmke with a balled fist, pulling his arm back and twisting his upper body. Ehmke then swung forward striking a pane of the window about shoulder level of Ehmke. Officer Fluke began to run toward Ehmke while continuing to hold his shield in both hands.

As Officer Fluke reached Ehmke, he shouted, “Get away from the window” and pushed the shield forward striking Ehmke in the lower torso and upper leg on Ehmke’s left side in an attempt to push Ehmke away from the window. This disoriented Ehmke, but he remained standing on the ledge. While using the CDU shield again, Officer Fluke attempted to push Ehmke again, causing Ehmke to fall to the ground on the landing. Officer Fluke lost grip of the shield and fell to the ground that was covered in shards of glass.

While Ehmke lay face-down on the ground, two other officers with the U.S. Capitol Police pulled Ehmke’s arms behind his back and detained him with
handcuffs. Office Fluke stood up and gave orders to the crowd to stay back and set a perimeter. Officers moved north on the landing to set up a perimeter with CDU shields between a crowd of approximately ten individuals in the immediate area and the two officers, Officer Fluke,
and Ehmke.

This small perimeter line of officers also blocked possible attempts of breaching the now visibly broken window which, to Officer Fluke’s knowledge, did not show signs of breakage prior to Ehmke striking the window. Ehmke was assisted onto his feet. USCP Officer Mooney obtained Ehmke’s California driver’s license and positively identified him as HUNTER ALLEN EHMKE.
Your affiant has spoken to Officer Mooney who reported that Ehmke also verbally identified himself. Officer Fluke asked Ehmke if he was injured, and Ehmke’s denied any injuries and there were no injuries visible.
Officer Fluke and Mooney attempted multiple times to go over the radio to advise their situation and seek further instructions. These attempts could not be clearly heard or unable to be broadcasted due to the many other calls of service by USCP officers. As the officers discussed an action plan, the disturbance caused individuals of the crowd facing the Rotunda doors to divert their attention towards the approximately 10 officers in the northwest corner of the landing.

Individuals in the throng began to show aggression by pointing fingers and shouting obscenities.
One unidentified individual threatened Officer Fluke and the other officers, stating “you’re not leaving with him” while pointing in the direction of Officer Fluke and Ehmke. Due to the growing aggression of the large crowd that far outnumbered the officers and the exigent circumstances at
the time, officers made the decision to allow Ehmke to depart under his own power. Officers took photos of Ehmke and the damaged window. Officers advised Ehmke that his actions were criminal and that they would seek a warrant for his arrest. Ehmke was told to immediately leave the Capitol grounds. Officers maintained custody of Ehmke’s driver’s license upon his release.

Federal prosecutors walk back sensational allegation of plot to kill lawmakers during Capitol siege

FROM JUST THE NEWS – Acting U.S. attorney in D.C. walks back charges filed in Arizona suggesting a plot to kill lawmakers.

The acting U.S. Attorney for the District of Columbia Michael Sherwin announced on Friday that there is no “direct evidence” indicating that the crowd of people who breached the Capitol on Jan. 6 had any intention of killing or kidnapping members of Congress. 

He told reporters, “We don’t have any direct evidence of kill-capture teams,” which seemed to contradict federal prosecutors in Arizona who had alleged on Thursday in a court filing that there was evidence rioters wanted “to capture and assassinate elected officials.”

Reuters reported that Sherwin was attempting to “walk back” the claims filed in Arizona, which were about Jacob Chansey, the so-called “Qanon shaman” who was shirtless and wearing horns in the Senate chamber. He allegedly left a note saying, “it’s only a matter of time, justice is coming.” – MORE

During national news coverage of the aforementioned events, video footage which appeared to be captured on mobile devices of persons present on the scene depicted evidence of violations of local and federal law, including scores of individuals inside the Capitol building without authority to be there.
A search of open sources revealed a video credited to Townhall Media, a political news organization, depicting various events that occurred at the Capitol on January 6, 2021.

Beginning at approximately thirteen minutes and six seconds, law enforcement officers attempt to remove individuals from the Rotunda and continue to do so for the next several minutes of the video. At approximately fourteen minutes and thirty-eight seconds, PERSON 1 is still in the Rotunda, and the back of his jacket is again visible. PERSON 1 stands taller than a number of individuals around him and can clearly be seen as law enforcement officers repeatedly attempt to remove him and others from the Rotunda.
At fourteen minutes and forty-one seconds, law enforcement officers appear to push PERSON 1 from behind. PERSON 1 can be seen standing in the Rotunda still wearing the dark-colored USA jacket, which also appears to bear a Nike logo on the front right side and a red and white Olympic patch on the front left side, as depicted in the below screenshot:

Kevin Seefried & His Son Hunter Carried Stars & Bars from Delaware, Aided Burglary of US Capitol thru Window and Marched into Rotunda

Statement of Facts

According to video footage from the U.S. Capitol, the defendants, Kevin Seefried and Hunter Seefried entered the Senate Building through a broken window at approximately 2:13 p.m. on January 6, 2021. Shortly thereafter, Defendant Kevin Seefried was photographed holding a Confederate Battle flag inside the Capitol Building (Exhibit A).
While in the building, both defendants were part of a larger group of individuals who verbally confronted several U.S. Capitol police officers for approximately 15 minutes. During this time, video footage from the U.S. Capitol Police shows Hunter Seefried using a phone to take a selfie photograph or video at approximately 2:29 p.m. The Defendants appear to depart the Capitol at approximately 2:36 p.m. from the Senate Carriage Door. At no time were they authorized to be inside the U.S. Capitol complex.
Defendants Kevin Seefried and Hunter Seefried were identified after the FBI received a report from a coworker of Hunter Seefried relaying that Hunter Seefried had bragged about being in the Capitol with his father on January 6, 2021. The reporting individual confirmed that Hunter
Seefried was visible in a Metropolitan Police Department flier depicting individuals who breached the Capitol Building’s security; he has a mustache and is wearing a black hat and black jacket.
(Exhibit B). The FBI reviewed Kevin Seefried’s driver’s license photo and it matched the image of the individual holding the Confederate Battle Flag. The FBI was also able to confirm that Kevin Seefried is Hunter Seefried’s father.
On January 12, 2021, both Kevin Seefried and Hunter Seefried participated in voluntary and separate interviews with the FBI. Both defendants confirmed their participation in the events at the Capitol as discussed herein. Kevin Seefried also explained that he brought the Confederate Battle flag seen in Exhibit A to the District of Columbia from his home in Delaware where it is usually displayed outside. Defendant Kevin Seefried told law enforcement that he had traveled with his family from Delaware to the District of Columbia to hear President Trump speak and that he and Hunter Seefried participated in a march from the White House to the Capitol led by an individual with a bull horn.
Finally, I have reviewed video footage posted to Twitter that shows Hunter Seefried punching out the glass in a window in the Capitol complex after people adjacent to him in the crowd broke it with a wooden 2 x 4. Kevin Seefried confirmed to law enforcement agents that Hunter Seefried was asked by an individual unknown to the Seefried’s to assist with clearing the window because Hunter Seefried was wearing gloves. After Hunter Seefried complied, people from the crowd outside, including the Seefried’s, were able to access the interior of the Capitol Building.

Based on the foregoing, your affiant submits that there is probable cause to believe that Kevin Seefried and Hunter Seefried violated 18 U.S.C. § 1752(a)(1) and (2), which makes it a crime to (1) knowingly enter or remain in any restricted building or grounds without lawful authority to do so; and (2) knowingly, and with intent to impede or disrupt the orderly conduct of
Government business or official functions, engage in disorderly or disruptive conduct in, or within such proximity to, any restricted building or grounds when, or so that, such conduct, in fact, impedes or disrupts the orderly conduct of Government business or official functions.

BLM/Antifa Activist John Sullivan Charged in Federal Court for Role In Capitol Riot

            WASHINGTON, D.C. – A Utah man was charged January 14, 2021, in federal court in the District of Columbia in connection with the riots at the U.S. Capitol on Wednesday, Jan. 6, 2021.

            John Earle Sullivan was charged by complaint with one count of knowingly entering or remaining in any restricted building or grounds without lawful authority, one count of violent entry and disorderly conduct on Capitol grounds, and one count of interfering with law enforcement engaged in the lawful performance of their official duties incident to and during the commission of civil disorder.  The defendant was arrested on January 14, 2021, in Utah.  

Statement of Facts

            The Complaint alleges that during the events at the U.S. Capitol, Sullivan, wearing a ballistics vest and gas mask, entered the U.S. Capitol through a window that had been broken out, pushing past U.S. Capitol Police once inside. The Complaint also alleges that Sullivan admits to filming and being depicted in video footage that shows him present, outside of the Speaker’s Lobby within the U.S. Capitol, at the shooting of a woman by a U.S. Capitol Police officer.

Sullivan’s video captured the fatal aftermath. Babbitt climbed through a broken window, and a law enforcement officer on the other side in the Speaker’s Lobby shot her.

  1. SULLIVAN, DOB , is a resident of Utah. Based on publicly available
    information and information provided by SULLIVAN in an interview on January 7, 2021, described further below, SULLIVAN is the leader of an organization called Insurgence USA through which he organizes protests. On July 13, 2020, SULLIVAN was charged with Rioting and Criminal
    Mischief by the local law enforcement authorities in Provo, Utah, based on his activities around a June 30, 2020, protest in which a civilian was shot and injured. The case is still pending.
  2. The United States obtained a video of SULLIVAN, posted on YouTube, in which, while attending a protest in Washington, D.C., SULLIVAN can be seen telling a crowd, over a microphone, “we about to burn this shit down,” “we got to rip Trump out of office . . . fucking pull him out of that shit . . . we ain’t waiting until the next election . . . we about to go get that
    motherfucker.” SULLIVAN then can be seen leading the crowd in a chant of, “it’s time for a revolution.

STATEMENT OF FACTS SUPPORTING PROBABLE CAUSE

  1. On January 7, 2021, SULLIVAN participated in a voluntary interview with a Federal Bureau of Investigation Special Agent in Washington, D.C. SULLIVAN identified himself to the agent and provided identifying information, including his date of birth, address, social media
    identifiers, and phone numbers. In the interview, SULLIVAN stated that he was in Washington, D.C. to attend and film the “Stop the Steal” March on January 6, 2021. SULLIVAN claimed to be an activist and journalist that filmed protests and riots, but admitted that he did not have any press credentials.
  2. SULLIVAN also stated that he was at the U.S. Capitol on January 6, 2021, when scores of individuals entered it. SULLIVAN stated he was wearing a ballistic vest and gas mask while there. He showed the interviewing agent the ballistic vest. He further stated that he entered the U.S. Capitol with others through a window that had been broken out. SULLIVAN stated he followed the crowd as the crowd pushed past U.S. Capitol Police and followed the crowd into the U.S. Capitol.
  3. SULLIVAN further stated that he had been present at the shooting of a woman within the U.S. Capitol by a U.S. Capitol Police officer and that he had filmed the incident. During the interview, SULLIVAN showed the interviewing agent the footage he had taken, which SULLIVAN stated he had uploaded to the Internet. The footage showed the area immediately
    outside of the Speaker’s Lobby within the U.S. Capitol. I know from public source information that the Speaker’s Lobby is the hallway from which one can enter directly into the chamber of the U.S. House of Representatives. The Speaker’s Lobby is set off from the rest of the Capitol Building by doors with glass windows. The footage that SULLIVAN showed the interviewing agent included footage of individuals breaking out the glass from the windows in the doors leading into the Speaker’s Lobby, then a gun being discharged by a U.S. Capitol Police officer within the Speaker’s Lobby, and a woman falling back into the crowd from a position of climbing through the opening in one of the broken windows with a gunshot wound. This woman was later identified as Victim 1.
  1. SULLIVAN also voluntarily provided two phone numbers and multiple social media accounts and identifiers to special agents, including a YouTube account username, JaydenX. At the conclusion of the interview, SULLIVAN stated that he was willing to voluntarily provide a copy of all footage he recorded within the U.S. Capitol to law enforcement
    authorities.
  2. On January 9, 2021, a task force officer with the FBI made contact with SULLIVAN at one of the phone numbers SULLIVAN provided during his January 7 interview to follow up on SULLIVAN’s offer to voluntarily provide his footage. SULLIVAN told the task force officer that
    the video he took within and around the U.S. Capitol on January 6, 2021, was in an iCloud account.
    The same day, SULLIVAN sent a link to law enforcement from a Google Photos account under the name “John Sullivan,” with an approximately 50-minute video. I have reviewed the video.2
  3. The video footage records approaching, entering, and moving through the U.S. Capitol on January 6, 2021. Although the video rarely shows SULLIVAN, at various points during it, SULLIVAN narrates as he is moving and can be heard speaking to other individuals and law
    enforcement officers. I recognize SULLIVAN’s voice in the video based on a January 11, 2021, voluntary interview I conducted with SULLIVAN at his residence, as described further below. In addition, at one point the camera pans to an individual wearing a tactical vest and holding a gas
    mask, as seen in the screenshots below, that match those SULLIVAN showed me during the interview conducted on January 11, 2021, also as further described in the paragraphs below:

            The case is being prosecuted by the U.S Attorney’s Office for the District of Columbia and the Counterterrorism Section of the Department of Justice’s National Security Division.  The case is being investigated by the FBI’s Salt Lake City and Washington Field Offices, the U.S. Capitol Police Department, and the Metropolitan Police Department.             Robert Sanford, 55, of Boothwyn, PA, was charged by criminal complaint with knowingly entering or remaining in any restricted building or grounds without lawful authority, disorderly or disruptive conduct on capitol grounds, civil disorder, and assaulting, resisting, or impeding certain officers while engaged in the performance of official duties.

THE COWARD ACTS

            It is alleged that during the events at the U.S. Capitol, Sanford struck three U.S. Capitol Police (USCP) officers with a fire extinguisher. A video, recorded by an individual who was present in the crowd, captures when a man throws what appears to be a fire extinguisher at a group of USCP officers protecting the lower west terrace of the Capitol.

The video was shot from an elevated position and showed an area of the Capitol with a large group of police officers surrounded on at least three sides by a group of insurrectionists. A United States Capitol Police (USCP) Special Agent identified the area shown in Video #1 as being the Lower West Terrace of the United States Capitol.

In the lower-left corner of the video, an individual, hereinafter “Subject,” is visible stepping over a short wall with a red object in their hands. The Subject is wearing what appears to be a stocking cap, a dark jacket or shirt with a plaid pattern, and a light and dark two-tone
backpack. Immediately after stepping over the short wall, the subject draws the red object, which appears to be a fire extinguisher, back in his right hand and then hurls the object at the group of
police officers. A screen capture of this video is included below; the Subject is in the lower-left corner with the red oval:

It is unknown at this time if Sanford is the same rioter that killed Capitol Police Officer Brian Sicknick.

Statement of Facts

            The fire extinguisher struck one officer, who was wearing a helmet, in the head; then, the fire extinguisher ricochets striking a second officer, who was not wearing a helmet, in the head; and ricochets a third time and strikes a third officer, wearing a helmet, in the head. After throwing the fire extinguisher at USCP, Sanford leaves the area in the opposite direction. Federal authorities were able to identify Sanford, after receiving a tip on January 12, 2021.

While a fellow law officer lay wounded by a blow from a fire extinguisher, these two idiot cops from Virginia were posing for a selfie and flipping the bird…

            WASHINGTON, D.C. – Two off-duty Rocky Mount, Virginia police officers were charged yesterday in federal court in the District of Columbia in connection with the riots at the U.S. Capitol on Wednesday, Jan. 6, 2021.

            Jacob Fracker and Thomas Robertson were charged by complaint with one count of knowingly entering or remaining in any restricted building or grounds without lawful authority and one count of violent entry and disorderly conduct on Capitol grounds. Both defendants were arrested on January 13, 2021, in Virginia.  It is alleged that during the events at the U.S. Capitol, Fracker and Robertson were photographed in the Capitol building making an obscene gesture in front of the John Stark statue. 

They couldn’t wait to post their cool photo online for their buddies back home in Rocky Mount…bragged about “taking the Capitol in one day”.

            On social media, Robertson is quoted as saying, “CNN and the Left are just mad because we actually attacked the government who is the problem and not some random small business … The right IN ONE DAY took the f***** U.S. Capitol. Keep poking us.” He also stated that he was “proud” of the photo on an Instagram post that was shared to Facebook, because he was “willing to put skin in the game.” On Facebook, Fracker posted a comment that read, “Lol to anyone who’s possibly concerned about the picture of me going around… Sorry I hate freedom? …Not like I did anything illegal…y’all do what you feel you need to.” The post has since been deleted.

Statement of Facts

           

In a statement to Newsweek, Defendant Robertson admitted that he and Defendant Fracker sent the photo to their police department colleagues, and after it was leaked to social media he reposted it on his own Facebook page. It has also been reported that Robertson stated that he broke no laws, did not know about the violence, and that he had been escorted “in” by the Capitol Police. Robertson made these claims notwithstanding his previous posts that he had “attacked the government” and “took the f**** Capitol.” Moreover, at that date and time, the United States Capitol was on lockdown and the defendants’ presence inside was without lawful authority.

           These cases are being prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Counterterrorism Section of the DOJ’s National Security Division, with assistance from the U.S. Attorney’s Office for the Western District of Virginia. The cases are being investigated by the FBI’s Washington Field Office and the United States Capitol Police The ATF and FBI continue to urge the public to report suspected use of explosive devices, or violent, destructive acts associated with the recent unrest. ROBERT PACKER WORE HIS FAVORITE NAZI SHIRT TO INVADE THE CAPITOL

Robert Keith Packer was charged with knowingly entering or remaining in any restricted building or grounds without lawful authority and violent entry or disorderly conduct on Capitol grounds. Packer was arrested on January 13, 2021, in Virginia.

Media coverage of these events showed one of the rioters who entered the Capitol building—a late-middle-aged white male with a full grey beard—wearing a sweatshirt bearing the words, “CAMP AUSCHWITZ” above an image of a human skull, and underlaid by the phrase, “WORK BRINGS FREEDOM.” Your affiant knows Auschwitz to have been a Holocaust concentration camp complex in Germany where Nazis murdered more than one million people between 1940 and 1945. Your affiant is further aware that an inscription on the Auschwitz concentration camp’s gate read, “Arbeit mact frei,” which translates approximately, in English, to
“work makes freedom.” Accordingly, the sweatshirt worn by the individual described above—and depicted in Photographs 1 and 2
1 below taken at the Capitol on January 6, 2021—appears to be a symbol of Nazi hate ideology.

A cooperating witness (hereafter CW-1) contacted law enforcement to notify them that CW-1 recognized the individual in PACKER’s photograph from the U.S. Capitol as a routine customer at a store near Newport News, Virginia. CW-1 did not identify PACKER by name but recognized PACKER’s sweatshirt and provided a photograph of PACKER inside the store on December 11, 2020:

FROM NEW YORK POST: Sen. Bill Cassidy on Tuesday tweeted a photo of a “person of interest” in the US Capitol riot, erroneously stating at first that the man was “wanted for questioning” in the death of Capitol Police Officer Brian Sicknick.
The Louisiana Republican clarified Tuesday afternoon that while the man depicted is being sought by authorities, he is not believed to be tied to Sicknick’s death.
“Capitol Police has informed me this individual is a person of interest, but for a separate incident that occurred at the Capitol on Jan. 6th,” the lawmaker wrote.
Cassidy asked anyone with information on the riot to contact the FBI.

Ryder Winegar Arrested for Threatening
Members of Congress

            CONCORD – Ryder Winegar, 33, of Amherst, was arrested on a federal complaint charging him with threatening members of Congress, United States Attorney Scott W. Murray announced January 12, 2021.

            The complaint filed in court alleges that on December 16 and 17, 2020, Winegar left voicemails at the offices of six members of the United States Congress in the District of Columbia.  In some of the messages, Winegar identified himself by name or identified his telephone number.  The voicemails threatened to hang the members of Congress if they did not “get behind Donald Trump.”  For example, in one message, Winegar allegedly said, “I got some advice for you.  Here’s the advice, Donald Trump is your president.  If you don’t get behind him, we’re going to hang you until you die.”

            Winegar was arrested on January 11, 2021, in Boston and is scheduled to appear before a federal magistrate judge later today. 

            The charges in the complaint are only allegations.  The defendant is presumed to be innocent unless and until proven guilty beyond a reasonable doubt in a court of law.

            The case was investigated by the U.S. Capitol Police with assistance from the United States Marshals Service, U.S. Customs and Border Protection, and the Amherst Police Department.

Charles County Sheriff Troy Berry Suspended Jail Guard; Conducting Investigation into Alleged Involvement in U.S. Capitol Riot

Charles County, MD – The Charles County Sheriff’s Department’s Office of Professional Responsibility, is investigating the possibility a corrections officer was inappropriately present on the grounds of the U.S. Capitol last week. On January 12, 2021, Sheriff Troy Berry said that command staff received an internal complaint of the employee’s possible involvement. 

At this time, there is no indication other employees were involved; however, should the Agency learn of other potential violations, immediate action will be taken. 

The employee has been suspended pending the outcome of the investigation.  

Sheriff Troy D. Berry said, “I wanted to immediately inform the community of this investigation and reassure them that we are working with federal authorities to determine what the employee’s exact involvement was and determine whether there was a violation of laws or agency policies. Let me be very clear: While I support lawful expressions of freedom of speech and assembly, I do not condone the violence or the threats to our democracy that we observed that day.  Our agency will work hand-in-hand with federal authorities in this matter.”

Roseanne Boyland, who died in the Capitol Riot, quit drugs only to spiral into QAnon

The medical emergency experienced by Rosanne Boyland turned out to be that she was trampled to death during a stampede in the U.S. Capitol rioting on January 6, 2021.
THE NEW YORK POST reported the following:
Rosanne Boyland had been busted for drugs over and over. Finally, she stepped up and got clean. She even wanted to be a sobriety counselor.
But she changed in other ways, too. She turned conservative. She bought into the conspiracy cult QAnon and she refused to believe Joe Biden defeated President Trump.
And her denial of Biden’s victory is what ultimately led to her death Wednesday, caught in the siege at the Capitol, her family told the Associated Press. She was one of three rioters who died of medical emergencies. A woman was fatally shot and a police officer was killed.   MORE

The Associated Press reported on January 9, 2021, the following:
Boyland’s friend, Justin Winchell, said Boyland was pinned to the ground when bodies of police and protesters pushed against each other. People began falling and then trampling one another, Winchell told WGCL-TV in Atlanta.

“I put my arm underneath her and was pulling her out and then another guy fell on top of her, and another guy was just walking (on top of her),” Winchell said. “There were people stacked two- to three-deep … people just crushed.

The two others who died of medical emergencies are Kevin Greeson, 55, of Athens, Alabama, and Benjamin Philips, 50, of Ringtown, Pennsylvania. Ashli Babbitt, 35, of San Diego, was fatally shot by police as she tried to climb through the broken window of a barricaded doorway inside the Capitol. MORE

FROM CBS.46.COM: The moment protestors turned violent on the steps of the United States Capitol, is the moment 34-year-old Roseanne Boyland from Kennesaw lost her life with her friend Justin by her side.

“What I saw it didn’t need to happen. It showed me that human life doesn’t really mean anything. I was trying, I was screaming,” Roseanne Boyland’s friend Justin Winchell said. 

Winchell said they found themselves in trouble when some demonstrators began pushing people in the crowd. Roseanne fell to the ground and was trampled.

“Rosanne turns her head up and it’s blue and I think she had been without oxygen face down when people laid on top of her and there were two other guys, I pulled off of her,” Winchell said.

“To be honest, this was very eye opening to see this firsthand because this was not people going there for the rally that were doing this that were inciting violence. I’m sorry,” Winchell said.

Winchell said he believes there were agitators mixed in the crowd who perpetrated the violence. He described them as un-American and not true Trump supporters. MORE

Will Pepe, a laborer at Metro-North’s Brewster rail yard, is under investigation for participating in the mob that briefly halted Congress as it was certifying the election of President-elect Joe Biden, the MTA confirmed.

Pepe, 31, of Beacon, N.Y., called out sick Wednesday to attend the event, an MTA source said. He has been suspended without pay as the agency seeks to fire him. MORE

“Please be advised that the information circulating on social media claiming to be from Acting Pardon Attorney Rosalind Sargent-Burns is inauthentic and should not be taken seriously. 

“The Justice Department’s Office of the Pardon Attorney does not have a social media presence and is not involved in any efforts to pardon individuals or groups involved with the heinous acts that took place this week in and around the U.S. Capitol.”

Two Men With Zip Ties Now Behind Bars

            WASHINGTON, D.C. – Two men were charged January 10, 2021 in federal court in the District of Columbia in connection with the riots at the U.S. Capitol on Wednesday, Jan. 6, 2021.

            Larry Rendell Brock, of Texas, was charged with one count of knowingly entering or remaining in any restricted building or grounds without lawful authority and one count of violent entry and disorderly conduct on Capitol grounds. Brock was arrested today in Texas.

            It is alleged that Brock was identified as one of the individuals who unlawfully entered the U.S. Capitol wearing a green helmet, green tactical vest with patches, black and camo jacket, and beige pants holding a white flex cuff, which is used by law enforcement to restrain and/or detain subjects.

AND ARREST WARRANT

I, Milagro Garcia, being first duly sworn, hereby depose and state as follows:
PURPOSE OF AFFIDAVIT

  1. This Affidavit is submitted in support of a Criminal Complaint charging LARRY RENDALL BROCK with violations 18 U.S.C. § 1752(a) and 40 U.S.C. § 5104(e). I respectfully submit that this Affidavit establishes probable cause to believe that BROCK (1) did knowingly enter or remain in any restricted building or grounds without lawful authority, or did knowingly, and with intent to impede or disrupt the orderly conduct of Government business or official functions, engage in disorderly or disruptive conduct, and (2) did willfully and knowingly engage in disorderly or disruptive conduct, at any place in the Grounds or in any of the Capitol Buildings with the intent to impede, disrupt, or disturb the orderly conduct of a session of Congress or either House of Congress, or the orderly conduct in that building of any deliberations of either House of Congress. Specifically, on or about January 6, 2021, BROCK traveled to Washington, D.C., and knowingly and willfully joined and encouraged a crowd of individuals who forcibly entered the U.S. Capitol and impeded, disrupted, and disturbed the orderly conduct of business by the United States House of Representatives and the United States Senate.

On January 8, 2021, a witness called the FBI National Threat Operations Center (NTOC) to report that she recognized BROCK in a picture taken inside the Capitol building during the rioting discussed above. The witness explained that she was BROCK’s ex-wife, and that the two had been married for eighteen years. The witness also stated that she recognized BROCK wearing a military-style helmet, khaki pants, gray and black fatigues over a military vest, and a patch from his military service. The witness stated, “I just know that when I saw this was happening I was afraid he would be there. I think you already know he was there. It is such a good picture of him and I recognize his patch.

On January 8, 2021, another witness contacted the FBI to report that he recognized BROCK in a picture taken inside the Capitol building on January 6, 2021. The witness sent the FBI an email with a picture of BROCK that had been taken inside the Capitol building on January 6, 2021. About the picture, the witness wrote, “It looks like him and he has pilot wings on his chest in this picture. He was an A-lO pilot. Worked at L3, and he still has contacts that work with L3 that knew he was flying to Washington DC.” The picture depicts BROCK in a military-style helmet, tactical vest, and holding flex-cuffs in his right hand.Law enforcement agents retrieved a driver’s license photo of BROCK, and confirmed that BROCK’s driver’s license photo bore a resemblance to the picture above.

On January 6, 2021, a video titled, “Inside the US Capitol as Trump supporters storm building – lTV News eyewitness report” was posted on YouTube. Two minutes and 39 seconds into the video, a man bearing a resemblance to the above-mentioned picture of BROCK can be seen
walking out of the Speaker of the United States House of Representatives Nancy Pelosi’s office.

On January 9, 2021, Ronan Farrow of The New Yorker magazine published an article titled, “An Air Force Combat Veteran Breached The Senate”

In the article, Farrow stated that two of BROCK’s family members identified him as the man wearing a military-style helmet, body armor, and holding flex-cuffs in the picture below.

            Eric Gavelek Munchel, of Tennessee, was charged with one count of knowingly entering or remaining in any restricted building or grounds without lawful authority and one count of violent entry and disorderly conduct on Capitol grounds. Munchel was arrested today in Tennessee.

            It is alleged that Munchel was inside of the U.S. Capitol on Jan. 6, 2021. Photos depicting his presence show a person who appears to be Munchel carrying plastic restraints, an item in a holster on his right hip, and a cell phone mounted on his chest with the camera facing outward, ostensibly to record events that day.

Nicholas R. Ochs Isn’t Long for Hawaii

HONOLULU, Hawaii – A criminal complaint was unsealed on January 9, 2021, in federal court in the District of Columbia charging Nicholas R. Ochs with Unlawful Entry into Restricted Buildings or Grounds, in violation of Title 18, United States Code, Section 1752(a). The defendant was arrested in Honolulu, Hawaii, at the Daniel K. Inouye International Airport. His initial appearance will be in federal court in Honolulu.

According to court filings, the charge stems from Ochs’s unlawful entry into the United States Capitol building on January 6, 2021. The government will seek his removal to the District of Columbia to face this charge.

The case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia.

            WASHINGTON, D.C. — Jacob Anthony Chansley, a.k.a. Jake Angeli, of Arizona, was charged with knowingly entering or remaining in any restricted building or grounds without lawful authority, and with violent entry and disorderly conduct on Capitol grounds. Chansley was taken into custody today.

            Federal prosecutors say that Chansley was identified as the man seen in media coverage who entered the Capitol building dressed in horns, a bearskin headdress, red, white, and blue face paint, shirtless, and tan pants. This individual carried a spear, approximately 6 feet in length, with an American flag tied just below the blade.

STATEMENT OF FACTS

With the joint session underway and with Vice President Mike Pence presiding, a large crowd gathered outside the U.S. Capitol. Temporary and permanent barricades surround the exterior of the U.S. Capitol building, and U.S. Capitol Police were present and attempting to keep the crowd away from the Capitol building and the proceedings underway inside. At approximately 2:00 p.m., certain individuals in the crowd forced their way through, up, and over the barricades and officers of the U.S. Capitol Police, and the crowd advanced to the exterior façade of the building. At such time, the joint session was still underway and the exterior doors and windows of
the U.S. Capitol were locked or otherwise secured. Members of the U.S. Capitol Police attempted to maintain order and keep the crowd from entering the Capitol; however, shortly after 2:00 p.m., individuals in the crowd forced entry into the U.S. Capitol, including by breaking windows.
Shortly thereafter, at approximately 2:20 p.m. members of the United States House of Representatives and the United States Senate, including the President of the Senate, Vice President Mike Pence, were instructed to—and did—evacuate the chambers.

Accordingly, the joint session of the United States Congress was effectively suspended until shortly after 8:00 p.m. Vice President Pence remained in the United States Capitol from the time he was evacuated from the Senate Chamber until the sessions resumed.
Media coverage of these events showed one of the rioters who entered the Capitol building dressed in horns, a bearskin headdress, red, white, and blue face paint, shirtless, and tan pants. This individual carried a spear, approximately 6 feet in length, with an American flag tied just below
the blade. The screenshots below of photographs posted on Twitter show this individual in the halls of Congress and standing on the dais inside the Senate chamber.

           

Several media outlets subsequently identified this individual as Jacob Anthony CHANSLEY, a.k.a. Jake Angeli. Your affiant has confirmed this identification of CHANSLEY.
First, the photographs of CHANSLEY in the U.S. Capitol display unique attire and extensive tattoos covering his arms and the left side of his torso. Your affiant has viewed pictures posted to the Facebook account for Jake Angeli on December 13, 2020, in which CHANSLEY bears this same distinctive attire and tattoos. In addition, CHANSLEY has a YouTube channel under the
name Jacob Chansley, on which a video posted of CHANSLEY from 2019 shows CHANSLEY with sleeve tattoos on the lower half of his arms consistent with the sleeve tattoos CHANSLEY displays in photographs taken in the Capitol on January 6, 2021. Finally, CHANSLEY has also been identified by law enforcement through open-source databases, including his Arizona DMV driver’s license photo, as the person depicted inside the Capitol and on the Senate dais on January 6, 2021.
In addition, on January 7, 2021, CHANSLEY called into the Washington Field Office of the FBI, to voluntarily speak with law enforcement. Your affiant and an FBI agent spoke on the phone with CHANSLEY, who confirmed that he was the male in the face paint and headdress in the Vice President’s chair in the Senate. CHANSLEY stated that he came as a part of a group
effort, with other “patriots” from Arizona, at the request of the President that all “patriots” come to D.C. on January 6, 2021.
Based on the foregoing, your affiant submits that there is probable cause to believe that CHANSLEY violated 18 U.S.C. § 1752(a)(1) and (2), which makes it a crime to (1) knowingly enter or remain in any restricted building or grounds without lawful authority to do; (2) knowingly, and with intent to impede or disrupt the orderly conduct of Government business or official functions, engage in disorderly or disruptive conduct in, or within such proximity to, any restricted building or grounds when, or so that, such conduct, in fact, impedes or disrupts the orderly conduct of Government business or official functions; or attempts or conspires to do so. For purposes of Section 1752 of Title 18, a “restricted building” includes a posted, cordoned off, or otherwise restricted area of a building or grounds where the President or other person protected by the Secret
Service, including the Vice President, is or will be temporarily visiting; or any building or grounds so restricted in conjunction with an event designated as a special event of national significance.

Your affiant submits there is also probable cause to believe that CHANSLEY violated 40 U.S.C. § 5104(e)(2)(A) and (G), which makes it a crime to willfully and knowingly (A) enter or remain on the floor of either House of Congress or in any cloakroom or lobby adjacent to that floor, in the Rayburn Room of the House of Representatives, or in the Marble Room of the Senate, unless authorized to do so pursuant to rules adopted, or an authorization given, by that House; and (G) parade, demonstrate, or picket in any of the Capitol Buildings.

ASHLI BABBITT’s LIFE IN MARYLAND INCLUDED ROAD RAGE CHASE OF HUSBAND’S EX-GIRLFRIEND

The NEW YORK POST reported: The Trump-boosting Air Force veteran who was gunned down after storming the US Capitol was once accused of chasing and harassing her husband’s ex-girlfriend —  repeatedly ramming the back of her car in a jealous rage, according to a report Friday.

Ashli Babbitt, 35 — who was among a mob of rioters who overpowered police and breached the building Wednesday — was charged with rear-ending her spouse’s former lover, Celeste Norris, three times on a Maryland highway in July 2016, according to court papers cited by the Daily Mail.

“She was waving erratically, and beeping the horn and appeared to be very angry,” Norris, 39, wrote in an affidavit about the incident. “I was fearful she would attempt to physically harm me.”

Babbitt, who eventually beat the rap, allegedly followed her from a shopping center in the city of Prince Frederick, Md., to an intersection before slamming into Norris’ car — then began screaming at her, the court papers state.

“I know McEntee to be in a relationship with my former boyfriend,” Norris wrote. “[She was] continuously waving her arms and yelling in my direction in a threatening manner.”Ashli Elizabeth McEntee (DOB 10/10/1985) with an address of 1352 Tanook Court, Annapolis, Md., was named as the respondent in a Peace Order issued by the St. Mary’s County Circuit Court on July 29, 2016.

After the crash, Norris called 911 as Babbitt allegedly got out of her SUV and began “verbally threatening” her, according to the affidavit. “She was screaming at me to get out of my vehicle … she was acting very erratic,” Norris said in the court papers.

Babbitt was charged with reckless endangerment, dangerous driving and malicious property damage for the crash — but was later acquitted, according to court papers.

But she also allegedly called in false police reports against Norris and harassed her with late-night phone calls, Norris later said in a restraining order, according to the outlet.

“Her continued efforts to disrupt my life, all I want is my life back and to move forward without having to worry about these attacks,” Norris wrote. Her restraining order was upheld.

Maryland court records reveal criminal charges, divorce

Celeste N. Norris, with her attorney Nicholas Joseph Ferrante of Prince Frederick, filed suit in Calvert County Circuit Court on July 25, 2019 for damages involving a motor vehicle collision, against Ashli Elizabeth McEntee, 4849 Cape May Avenue, San Diego, California. The litigation was dismissed by the court for lack of jurisdiction on January 14, 2020. Two criminal charges against Ashli McEntee with Celeste Norris listed as the complainant, resulted in judgement of acquittal on December 16, 2016.  The misdemeanor charges were reckless endangerment and malicious property destruction of less than $1,000.

Timothy Vaughn McEntee filed for divorce from Ashli E. McEntee in Anne Arundel County Circuit Court on August 5, 2018.  The uncontested action was recommended for approval by the Magistrate and certified by the Circuit Court on May 14, 2019.

Aaron R. Babbitt sold a home located at 2021 Lowery Oaks Lane in Huntingtown, Md., in Calvert County on May 18, 2017 for $330,000.  This address was listed for Ashli McEntee in Maryland court records when she was listed as a defendant for the road rage incident that occurred in Calvert County on June 29, 2016. She was cited by a citizen citation with willful motor vehicle damage and tampering. On December 16, 2016, she was found not guilty.

Aaron Babbitt purchased the property in Huntingtown in 2010.

Ashli Elizabeth McEntee is chief executive officer of Fowlers Pool Service & Supply Inc. in Spring Valley, California, near San Diego, according to California secretary of state business records. The company’s chief financial officer is Aaron Raymond Babbitt, her husband.

Babbitt’s ex-husband, Timothy McEntee, called her a “wonderful woman with a big heart and a strong mind” in an email to The San Diego Union-Tribune. McEntee said he and Babbitt were married from April 2005 to May 2019.

A Facebook account with Babbitt’s name says she married Aaron Babbitt on June 25, 2019, and identifies her employer as Fowlers Pool Service.

The Air Force said Thursday that Ashli Elizabeth McEntee was on active duty from 2004 to 2008, most recently at Dyes Air Force Base near Abilene, Texas. She was also a member of the Air Force Reserve from 2008 to 2010 and the Air National Guard from 2010 to 2016.

Adam Christian Johnson, 36, (DOB 12/16/1984) of 9615 58th Street, Parrish, Florida, was booked into the Pinellas County Sheriff Jail in Florida on January 8, 2021, at 9:07 pm and held under a Federal warrant placed by the United States Marshal, pending trial.

Adam Johnson who was seen at the Capitol Riot carrying Speaker Pelosi’s lectern in the Rotunda is booked into Pinellas County jail on the video.

Johnson was featured in a photo by photo captured by chief Getty Images photographer Win McNamee as he pranced like a wounded elk through the Capitol with the podium used by Speaker Nancy Pelosi for press conferences and other events.  The photo was widely distributed through the press by the FBI and numerous tips came in from the Bradenton area leading the FBI to arrest Johnson and book him into the Pinellas County Jail.

The Bradenton Herald reported that Johnson lives in Parrish with his wife and their five children. He is a stay-at-home father, who makes and sells furniture, while his wife is a doctor in Palmetto. Johnson was reported by the Miami Herald as a self-employed furniture maker who is a stay-at-home father.

On or about January 7, 2021, law enforcement received information from U.S. Capitol authorities that the Speaker of the House’s lectern was missing. A search of open sources revealed an image credited to Getty Images, a visual media company, showing an unknown individual
(PERSON 1) appearing to carry the lectern throughout the U.S. Capitol building (see Figure 1). In the image, a large seal with the words “Seal Of The Speaker United States House Of Representatives 1789” is clearly visible on the lectern. The image had been widely circulated on online news sources and social media, and online commentary indicated that the image was taken

during the forced-entry event at the U.S. Capitol on January 6, 2021. PERSON 1 can be seen with what appeared to be red facial hair, wearing a gray jacket, blue knit cap with white lettering, and a backpack. On January 8, 2021, during a conversation with the FBI, U.S. Capitol Police (USCP)
identified the location of PERSON 1, as shown in Figure 1, as within the rotunda of the Capitol building.

Additional open-source research revealed an article published by the Sarasota HeraldTribune, an organization that provides news related to the city of Sarasota, Florida. The article contained an image of what appeared to be a social media post by a person with the username “Adam Johnson.” The post contained another image of what appeared to be PERSON 1, again
with what appeared to be red facial hair and wearing the same gray jacket, blue knit cap with white lettering, and backpack as seen in Figure 1, posing by a sign that read “Closed to all tours” (see Figure 2). The caption accompanying the photograph, seemingly in response to the sign, says
“No.” USCP subsequently identified the location of PERSON 1, as shown in Figure 2, as inside the Capitol building, likely on the second floor in the hallway near the Old Senate Chamber. USCP also indicated that the sign seen in Figure 2 was consistent with signs normally used in the U.S.
Capitol building. The Sarasota Herald-Tribune article indicated that the photograph likewise was taken during the forced-entry event at the U.S. Capitol on January 6, 2021, and that social media users had indicated PERSON 1 was named ADAM JOHNSON and a resident of Bradenton,
Florida.

Newly-sworn in West Virginia Delegate Derrick Evans now faces federal charges after sweeping into the U.S. Capitol with a mob this week, federal law enforcement officials said during a press call today.

“We’re in! We’re in! Derrick Evans is in the Capitol!” the new lawmaker said live on video.

He faces two federal misdemeanors, both punishable with fines and potential jail time: entering a restricted public building and violent entry and disorderly conduct on Capitol grounds.

The initial announcement of the charges against Evans came partway into a press briefing today with acting U.S. Attorney Michael Sherwin for the District of Columbia. The federal officials participating in the call seemed to learn of the charges in that moment and said more detail would be released soon.

“I just received word that we have now a signed complaint also against a Delegate who serves in the West Virginia Legislature,” said Ken Kohl, a top deputy federal prosecutor in Washington, D.C.

“He has been charged — and, I think, according to reports had recorded himself storming the Capitol — he is charged with entering restricted area and entering the United States Capitol. That report is also being released today as well. That defendant’s name is Derrick Evans. Derrick Evans.”

Thirteen individuals have been charged so far in federal court in the District of Columbia related to crimes committed at the U.S. Capitol in Washington, D.C, on Wednesday, Jan. 6, 2021. In addition to those who have been charged, additional complaints have been submitted and investigations are ongoing.

“The lawless destruction of the U.S. Capitol building was an attack against one of our Nation’s greatest institutions,” said Acting U.S. Attorney Michael Sherwin. “My Office, along with our law enforcement partners at all levels, have been expeditiously working and leveraging every resource to identify, arrest, and begin prosecuting these individuals who took part in the brazen criminal acts at the U.S. Capitol. We are resolute in our commitment to holding accountable anyone responsible for these disgraceful criminal acts, and to anyone who might be considering engaging in or inciting violence in the coming weeks – know this: you will be prosecuted to the fullest extent of the law.”

“ATF is committed to the rule of law and the protection of all citizens’ Constitutional rights,” said Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Deputy Director Regina Lombardo. “We continue to support our law enforcement partners to ensure those who violated the law during the events at the Capitol this week are brought to justice. DC Attorney General Says All Actors Are Being Considered for Inciting Riot, Including President Trump

FROM THE NEW YORK POST: WASHINGTON — President Trump, son Donald Trump Jr., and Rudy Giuliani may all be investigated and charged for their potential roles in inciting a violent mob that stormed the US Capitol, Washington, DC’s top prosecutor hinted Friday.

In an interview with “Good Morning America,” DC Attorney General Karl Racine, whose office is investigating dozens of rioters, laid the blame at the feet of the president for his fiery speech to supporters before many of them invaded Congress.

“I think the question is, how far up does it go? Clearly the Capitol was ground central in all of this mob’s behavior,” Racine said.

“Donald Trump Jr., Giuliani, even the president of the United States, were calling on their supporters and hate groups to go to the Capitol and in the words of Rudy Giuliani ‘exercise combat justice,’” he went on “We’re going to investigate not only the mobsters but also those who invited the violence.”

The Department of Justice has not ruled out bringing charges against Trump, who will become a private citizen when he leaves office on Jan. 20.

In a call with reporters Thursday, Michael Sherwin, the US attorney for the District of Columbia, said his office would look at anyone involved in the riot who broke the law.

“We are looking at all actors here. Was there a command and control? Were there others that may be assisted or facilitated or obviously played some ancillary role in this?” Sherwin said.

Thirteen individuals have been charged with federal crimes. The defendants and charges are outlined below:

With the joint session underway and with Vice President Mike Pence presiding, a large crowd gathered outside the U.S. Capitol. Temporary and permanent barricades surround the exterior of the U.S. Capitol building, and U.S. Capitol Police were present and attempting to keep
the crowd away from the Capitol building and the proceedings underway inside. At approximately 2:00 p.m., certain individuals in the crowd forced their way through, up, and over the barricades and officers of the U.S. Capitol Police, and the crowd advanced to the exterior façade of the building. At such time, the joint session was still underway and the exterior doors and windows of the U.S. Capitol were locked or otherwise secured. Members of the U.S. Capitol Police attempted to maintain order and keep the crowd from entering the Capitol; however, at approximately 2:15
p.m., individuals in the crowd forced entry into the U.S. Capitol, including by breaking windows.
Shortly thereafter, members of the United States House of Representatives and the United States Senate, including the President of the Senate, Vice President Mike Pence, were instructed to—and did—evacuate the chambers. Accordingly, the joint session of the United States Congress was effectively suspended until approximately 8:00 p.m.
During national news coverage of the aforementioned events, video footage which appeared to be captured on mobile devices of persons present on the scene depicted evidence of violations of local and federal law, including scores of individuals inside the U.S. Capitol building without authority to be there.
In the course of my duties, I learned that an individual entered the restricted office area of the Speaker of the House of Representatives Nancy Pelosi, and took photographs with his feet propped up on furniture. Those photos were circulated on numerous news media platforms that
identified the individual as RICHARD BARNETT of Gravette, Arkansas. Capitol Police searched law enforcement databases including Department of Motor Vehicle records and obtained a photograph and biographical information for BARNETT. These records confirmed that the individual in the news photographs did in fact appear to be RICHARD BARNETT of Gravette, Arkansas.
The photos circulated by news media depict BARNETT in and around U.S. Capitol property. One photo shows BARNETT seated inside of Nancy Pelosi’s office with his feet propped on a desk with an American flag lying on an adjacent credenza. BARNETT is wearing a hat, plaid jacket, blue jeans, and brown boots in the photo. Another photo depicts BARNETT seated holding an envelope in his left hand addressed to The Honorable Billy Long 2453 Rayburn House Office Building Washington, D.C. 20515 and a digital signature of Nancy Pelosi. In another photo, an individual whose face is blocked by a flag but appears to be BARNETT based on his clothing is
seated at a different desk with his feet propped holding an American flag and a cell phone. Another unidentified individual in a brown jacket is sitting next to him on a couch.
Video surveillance from a camera positioned outside of the Speaker’s main office door captures individuals entering and exiting the office. At approximately 2:30 p.m., several unidentified individuals appear to try the door to the office however the door is locked. At approximately 2:33 p.m. an unidentified individual pushes in the door to the office. At 2:50 p.m.
BARNETT is captured on surveillance video carrying an American flag and a cellular phone while entering the doors which lead to the Speaker’s conference room adjoining the main office space.
As he is entering it, he is following behind the unidentified individual in the brown jacket. At 2:56 p.m. BARNETT is captured leaving the main office doors of the Speaker’s office space with only a phone in his hand.

On the same date, BARNETT spoke to media outlets in a video recording. In the recording, BARNETT is wearing the same hat and plaid jacket as worn inside of the Speaker’s office except that BARNETT appears to have removed his shirt.

BARNETT is asked by a person off-camera how BARNETT obtained an envelope he is holding, which was addressed to The Honorable Billy Long 2453 Rayburn House Office Building Washington, D.C. 20515 with a return address of Office of the Speaker U.S. House of Representatives Washington, D.C. 20515 and a digital signature of Nancy Pelosi. BARNETT states “I did not steal it. I bled on it because they were macing me and I couldn’t fucking see so I figured I am in her office. I got blood on her office. I put a quarter on her desk even though she ain’t fucking worth it. And I left her a note on her desk that says “Nancy, Bigo was here, you Bitch.”
In another photograph that appears to be taken outside on Capitol grounds, BARNETT is depicted holding the envelope he purported to have taken from Speaker Pelosi’s office. Based on the writing on the envelope, the envelope appears to be the same envelope BARNETT was photographed holding inside of the office building.
Based on the foregoing, your affiant submits that there is probable cause to believe that BARNETT violated 18 U.S.C. § 1752(a), which makes it a crime to (1) knowingly enter or remain in any restricted building or grounds without lawful authority to do; or (2) knowingly, and with intent to impede or disrupt the orderly conduct of Government business or official functions,
engage in disorderly or disruptive conduct in, or within such proximity to, any restricted building or grounds when, or so that, such conduct, in fact, impedes or disrupts the orderly conduct of Government business or official functions. For purposes of Section 1752 of Title 18, a restricted
building includes a posted, cordoned off, or otherwise restricted area of a building or grounds where the President or other person protected by the Secret Service is or will be temporarily visiting, or any building or grounds so restricted in conjunction with an event designated as a
special event of national significance.
Your affiant also submits that there is probable cause to believe that BARNETT violated 40 U.S.C. §5104(e)(2)(C), (D), and (G), which makes it a crime to willfully and knowingly (C) with the intent to disrupt the orderly conduct of official business, enter or remain in a room in any
of the Capitol Buildings set aside or designated for the use of – (i) either House of Congress or a Member, committee, officer, or employee of Congress, or either House of Congress; or (ii) the Library of Congress; (D) utter loud, threatening, or abusive language, or engage in disorderly or
disruptive conduct, at any place in the Ground or in any of the Capitol Buildings with the intent to impede, disrupt or disturb the orderly conduct of a session of Congress or either House of Congress, or the orderly conduct in that building of a hearing before, or any deliberations o( a committee of Congress or either House of Congress; or (G) parade, demonstrate, or picket in any of the Capitol Buildings.
Furthermore, your affiant submits, there is probable cause to believe that BARNETT also violated 18 U.S.C. § 641, which makes it a crime to steal or purloin…, a thing of value of the United States or of any department or agency thereof or any prope1iy made… for the United States or any
department or agency thereof … ”
For purposes of this section, the word ”value” means face, par, or market value, or cost price, either wholesale or retail, whichever is greater.

Affidavit in support of the criminal arrest of Lonnie Coffman

  1. Lonnie Coffman, of Alabama, was charged on Jan. 7, 2021, with possession of an unregistered firearm (destructive device) and carrying a pistol without a license. It is alleged that Coffman’s vehicle contained 11 explosive devices known as Molotov cocktails and firearms. It is further alleged he was in possession of two firearms. Coffman was arrested and is currently being held. His detention hearing is scheduled for Jan. 12, 2021.

AFFIDAVIT IN SUPPORT OF CRIMINAL COMPLAINT
On January 6, 2021, a joint session of the United States Congress convened at the United States Capitol, which is located at First Street, Southeast, in Washington, D.C. Specifically, elected members of the United States House of Representatives and the United States Senate were meeting
in separate chambers of the Capitol to certify the vote count of the Electoral College of the 2020 Presidential Election, which had taken place on November 3, 2020. The joint session began at approximately 1:00 p.m. Vice President Michael R. Pence was present and presiding in the Senate
chamber.
Shortly before the joint session was scheduled to begin, at approximately 12:47 p.m. on January 6, 2021, officers of the United States Capitol Police responded to the report of a possible explosive device in the vicinity of the National Republican Club, which is located at 300 First
Street, Southeast, in Washington, D.C.
Shortly after the initial report of the possible explosive device in the vicinity of the National Republican Club, United States Capitol Police received a report of an additional possible explosive device at the Democratic National Committee Headquarters, which is located at 430 South Capitol
Street, Southeast, in Washington, D.C. This location is approximately three blocks from the National Republican Club. The bomb squad of the United States Capitol Police responded to both locations to provide assistance in the investigation and to render the possible explosive devices safe.
Also as part of its response to the two reports of explosive devices, United States Capitol Police officers established a secure perimeter in an effort to protect the public and to facilitate the investigation of the possible explosive devices and any others in the vicinity. In connection with securing the area, canine units of the United States Capitol Police conducted investigative sweeps of the area. These investigative sweeps included canine sniffs and visual inspection of vehicles in the vicinity of the possible explosive device. While conducting these canine sweeps, two United States Capitol Police officers observed the handle of what appeared to be a firearm on the front
right passenger seat of a red GMC Sierra 1500 pickup truck with Alabama license plate 52HJ703.
A law enforcement database check of the vehicle registration revealed that the vehicle was registered to Lonnie L. Coffman with a home address in Falkville, Alabama.
After addressing the explosive devices found in the vicinity of the National Republican Club and the Democratic National Committee Headquarters, the Bomb Squad responded to the location of the Red GMC Sierra Pickup truck. One black handgun was recovered from the right front passenger seat of the vehicle. After locating the black handgun, officers proceeded to search the rest of the pickup truck, including the bed of the truck, which was secured under a fabric top.
During the search of the cab of the truck, officers recovered, among other things, one M4 Carbine assault rifle along with rifle magazines loaded with ammunition.
In addition, officers recovered the following items in the bed of the pickup truck in close proximity to one another: (i) eleven mason jars containing an unknown liquid with a golf tee in the top of each jar, (ii) cloth rags, and (iii) lighters. Upon finding these materials, bomb technicians observed that the items appeared to be consistent with components for an explosive or incendiary device known as a “Molotov Cocktail.” Based on this discovery, additional personnel were called to the scene, including the United States Capitol Police Hazardous Materials Team. A preliminary
test by the United States Capitol Police Hazardous Material Team determined that the liquid in the mason jars was an igniting substance and that it had a spectrograph profile consistent with gasoline.
An explosive enforcement officer and a certified explosive specialist, both with the Bureau of Alcohol Tobacco Firearms and Explosives, were consulted and each stated that, based on their training and experience, the (i) eleven mason jars containing an unknown liquid with a golf tee in
the top of each jar, (ii) cloth rags, and (iii) lighters found in close proximity to one another constitute a combination of parts either designed or intended for use in converting any device into a “destructive device,” as defined in 26 U.S.C. § 5845(f), and from which a “destructive device”
may be readily assembled. Possession of the above-referenced components without registering any “destructive devices” with the National Firearms Registration and Transfer Record violates 26 U.S.C. § 5861(d).
At approximately 6:30 p.m., a blue sedan with a female driver and a male front passenger approached law enforcement officers in the 400 block of First Street, Southeast. Officers made contact with the vehicle, and the male passenger stated that he was trying to get to his vehicle that was parked in the 300 block of First Street, Southeast, which is the location that the Red GMC Sierra 1500 pickup truck had been located and searched. When the officers asked the man to provide a description of the vehicle, the male passenger stated that it was a red pickup truck. The officers then asked what the male passenger’s name was, and he stated that his name was “Lonnie.”
As noted herein, officers had previously determined that the red GMC Sierra 1500 pickup truck with Alabama license plate 52HJ703 was registered to Lonnie L. Coffman. The man asked officers whether they had located the bombs, which officers initially understood to be a reference to the components to the destructive devices located in COFFMAN’s truck, but later understood to be a reference to the secure perimeter that had been set up by law enforcement, which perimeter had kept COFFMAN from returning to his car earlier.
Based on the man’s statements and their understanding of the statements at the time, the officers asked the male passenger if he would step out of the vehicle so that they could assist him further with locating his vehicle. Upon exiting the vehicle, the officers asked the male passenger if he had any weapons on his person, and he responded that he had a gun in his right front pants pocket. The officers then detained the male passenger—later confirmed to be Lonnie L. COFFMAN—and officers conducted a search of the right pocket which revealed a handgun, later fully identified as a 9mm Smith & Wesson handgun with serial number LFN2577, and a set of
GMC vehicle keys. After securing the 9mm Smith & Wesson, officers conducted a further search of COFFMAN and recovered a 22 caliber derringer style handgun from his front left pocket along with another set of GMC vehicle keys. Both sets of keys matched the vehicle and were capable of unlocking its door. Officers also recovered a wallet from COFFMAN’s person, which contained an Alabama driver’s license with the name Lonnie Leroy Coffman and the same address in Falkville, Alabama, that was returned from a database check of the vehicle registration for the red
GMC Sierra Pickup.
According to records checks of the National Firearms Registration and Transfer Record database using COFFMAN’s name and date of birth, neither the firearms recovered from COFFMAN’s person or his pickup truck nor the destructive devices described above, are registered to him. In addition, COFFMAN has not registered any firearms in accordance with D.C.
law.
Thereafter, law enforcement asked COFFMAN a series of questions about possible explosive devices in an effort to further secure public safety. Among other things, law enforcement asked COFFMAN about the contents of the mason jars. COFFMAN stated that the mason jars contained “melted Styrofoam and gasoline.” An explosive enforcement officer with the Bureau of Alcohol Tobacco Firearms and Explosives has advised that melted Styrofoam and gasoline are an explosive mixture that has the effect of napalm insofar as it causes the flammable liquid to better stick to objects that it hits upon detonation.
COFFMAN was later asked about his earlier statement to officers in which COFFMAN had asked officers if they had located bombs. COFFMAN denied that he was referring to any bombs that he had knowledge of, and he explained that he was simply referring to his understanding based on the perimeter that had been established, which had kept COFFMAN from
returning to his pickup truck. At this point, the United States Capitol Police does not attribute the explosive devices at the National Republican Club and the Democratic National Committee Headquarters to COFFMAN.
Law enforcement reviewed video surveillance footage from the area where the vehicle was discovered. The video footage indicates that the vehicle was parked there at around 9:15 a.m. and that around five minutes later one and only one individual departed the vehicle from the driver’s side door. The video footage reveals that the person who departed the vehicle was wearing a jacket with a patch consistent with clothing worn by COFFMAN when he was arrested.
Based upon the above information, there is probable cause to believe that Lonnie Leroy COFFMAN, on or about January 6, 2021, did possess destructive devices in violation of Section 5861(d) of Title 26 of the United States Code. In addition, there is probable cause to believe that
Lonnie Leroy COFFMAN, on or about January 6, 2021, did carry a pistol without a license outside of a home or business in violation of D.C. Criminal Code 22-4504(a).

Mark Leffingwell, was charged on Jan. 7, 2021, with knowingly entering or remaining in any restricted building or grounds without lawful authority; assault on a federal law enforcement officer; and violent entry and disorderly conduct on Capitol grounds. Leffingwell allegedly entered the Senate side of the Capitol and when stopped by law enforcement, struck an officer in the helmet and chest. Leffingwell is currently being held and has a detention hearing in district court on January 8, 2021..

On January 6, 2021, I was on duty and performing my official duties as an Officer in the United States Capitol Police. Specifically, I was detailed and deployed in uniform at the United States Capitol building to provide protective functions for members of Congress and their staff.
As an Officer in the United States Capitol Police, I am authorized by law or by a Government agency to engage in or supervise the prevention, detention, investigation, or prosecution of a violation of Federal criminal laws.

At approximately 2:30 p.m. on January 6, 2021, I was performing my official duties on the first floor of the United States Capitol building. In reacting to the crowd that had breached a window of the building, I moved to a hallway in the northwest corner of the building, i.e., the Senate wing of the Capitol building. While there, I attempted to form a barrier with other officers to stop or deter additional individuals from entering the Capitol building. In the course of this effort and while inside the Capitol building, I encountered an adult male who later identified himself to me as Mark Jefferson LEFFINGWELL. LEFFINGWELL attempted to push past me and other officers. When he was deterred from advancing further into the building, LEFFINGWELL punched me repeatedly with a closed fist. I was struck in the helmet that I was wearing and in the chest. Working with other officers, I was able to gain control over LEFFINGWELL, who
attempted to struggle while being detained. I transported LEFFINGWELL to United States Capitol Police headquarters for processing. While in custody, but prior to being advised of his Miranda

On Wednesday, January 6, 2021, I was on duty, in full uniform, serving as part of Civil Disturbance Unit (CDU) 53 deployed to U.S. Capitol grounds in response to a mass demonstration where protesters had stormed the U.S. Capitol.

After several hours of attempting to remove demonstrators from Capital grounds, at approximately 1800 hours, CDU officials increased their efforts by broadcasting over a loudspeaker that the demonstrators were in violation of the mayor’s curfew order. They continued to broadcast that
message for approximately one hour. At approximately 1920 hours, a combined effort involving MPD CDU and DC National Guard troops began to encircle the remaining crowd, located on the grounds of the U.S. Capitol Building at the U.S. Capitol Visitor Center, so as to begin mass arrest
procedures for the remaining demonstrators who refused to leave.
District of Columbia Mayor Muriel Bowser declared a public emergency in the District of Columbia (Mayor’s Order 2021-001, pursuant to 24 DCMR § 2203.2), which resulted in a District-wide curfew commencing at 6:00 p.m. on Wednesday, January 6, 2012, and ending at 6:00 a.m. on Thursday, January 7, 2021.
At approximately 1925 hours (7:25 p.m.), I was assisting escorting individuals past an MPD line when I noticed a man, later identified by his Maryland driver’s license as CHRISTOPHER ALBERTS, to be slow in responding to orders to leave the premises. As I approached ALBERTS


from his rear, I noticed a bulge on ALBERTS’ right hip. Based on my training and experience, I recognized the bulge was consistent with that of a handgun. While pushing ALBERTS towards the line, I tapped the bulge with my baton and felt a hard object that I immediately recognized to be a firearm. At the time, ALBERTS was also wearing a bullet-proof vest and carrying a backpack.
At that point, I told two MPD officers next to him that ALBERTS had a firearm on his person.
ALBERTS, apparently hearing that, immediately tried to flee, but I was able to detain him with the help of two other officers. A black Taurus G2C 9mm (Serial#AAL085515) was recovered from D-1’s right hip. Additionally, a separate magazine was located on D-1’s left hip. Both the gun and
the spare magazine were held in two separate holsters. The handgun had one round in the chamber with a twelve round capacity magazine filled with twelve rounds; the spare magazine also had a twelve round capacity and was filled with twelve rounds. MPD Officers also seized a gas-mask from the defendant’s person as well as the defendant’s backpack containing a pocketknife, one packaged military meal-ready to eat (MRE), and one first-aid medical kit.
The MPD Gun Recovery Unit was dispatched and ALBERTS was subsequently placed under arrest for Carrying a Pistol without a License, Possession of a firearm on Capital Grounds, Curfew Violation, Possession of Unregistered Ammunition, and Possession of a High Capacity
Ammunition Feeding Device, and was transported to 5D for processing.

  1. Joshua Pruitt was charged on Jan. 7, 2021, with knowingly entering or remaining in any restricted building or grounds without lawful authority. The defendant appeared in district court and was released. He has a preliminary hearing scheduled for Jan. 28, 2021.
  2. Matthew Council, of Florida, was charged on Jan. 7, 2021, with knowingly entering or remaining in any restricted building or grounds without lawful authority and violent entry and disorderly conduct on Capitol grounds. Council allegedly unlawfully entered the Capitol building, and when stopped by law enforcement, he pushed the officer.

Statement of Facts

At approximately 3:00 p.m. on January 6, 2021, I was performing my official duties on the first floor of the United States Capitol building. In reacting to the crowd that had breached a window of the building, I moved to a hallway in the northwest corner of the building, i.e., the Senate wing of the Capitol building. While there, I attempted to form a barrier with other officers to stop or deter additional individuals from entering the Capitol building through an emergency entrance/exit that had breached by individuals who had accessed the Capitol. In the course of this effort and while inside the Capitol building, I encountered an adult male who was later identified as Matthew Ross COUNCIL. He was part of a larger
group, but was individually pushing against the barrier to include an emergency door that is kept closed.
Once the door was forcibly opened he broke through along with others. All during this time, he was continually yelling at police officers that were trying to contain the scene. When he was deterred from advancing further into the building, COUNCIL pushed a uniformed officer of the United States Capitol Police. COUNCIL was subsequently pepper-sprayed by one or more other law enforcement officers. The pepper spray also had an effect on me, but I was able to respond and detain COUNCIL. While in custody, but prior to being advised of his Miranda rights, COUNCIL spontaneously expressed remorse about pushing the officer and indicated that he did not intend to injure her.
Based on the foregoing, your affiant submits that there is probable cause to believe that COUNCIL violated 18 U.S.C. § 1752(a), which makes it a crime to (1) knowingly enter or remain in any restricted building or grounds without lawful authority to do; (2) knowingly, and with intent to impede or disrupt the orderly conduct of Government business or official functions, engage in disorderly or disruptive conduct in, or within such proximity to, any restricted building or grounds when, or so that, such conduct, in fact,
impedes or disrupts the orderly conduct of Government business or official functions; (3) knowingly, and


with the intent to impede or disrupt the orderly conduct of Government business or official functions, obstruct or impede ingress or egress to or from any restricted building or grounds; or (4) knowingly engage
in any act of physical violence against any person or property in any restricted building or grounds; or attempts or conspires to do so. For purposes of Section 1752 of Title 18, a restricted building includes a
posted, cordoned off, or otherwise restricted area of a building or grounds where the President or other person protected by the Secret Service is or will be temporarily visiting; or any building or grounds so restricted in conjunction with an event designated as a special event of national significance.
Further, your affiant submits that there is probable cause to believe that COUNCIL violated 40 U.S.C. § 5104(e)(2), which makes it a crime for an individual or group of individuals to willfully and knowingly (A) enter or remain on the floor of either House of Congress or in any cloakroom or lobby adjacent to that floor, in the Rayburn Room of the House of Representatives, or in the Marble Room of the Senate, unless authorized to do so pursuant to rules adopted, or an authorization given, by that House; (B) enter or remain in the gallery of either House of Congress in violation of rules governing admission to the gallery adopted by that House or pursuant to an authorization given by that House; (C) with the intent to disrupt the orderly conduct of official business, enter or remain in a room in any of the Capitol Buildings set aside or designated for the use of— (i) either House of Congress or a Member, committee, officer, or employee of Congress, or either House of Congress; or (ii) the Library of Congress; (D) utter loud,
threatening, or abusive language, or engage in disorderly or disruptive conduct, at any place in the Grounds or in any of the Capitol Buildings with the intent to impede, disrupt, or disturb the orderly conduct of a
session of Congress or either House of Congress, or the orderly conduct in that building of a hearing before, or any deliberations of, a committee of Congress or either House of Congress; (E) obstruct, or impede passage through or within, the Grounds or any of the Capitol Buildings; (F) engage in an act of physical violence in the Grounds or any of the Capitol Buildings; or (G) parade, demonstrate, or picket in any of the Capitol Buildings.

In a loud and clear voice, Capitol Police Officers ordered the crowd to leave the building. The crowd did not comply and instead responded by shouting and cursing at the Capitol Police Officers. I observed that the crowd, which at the time was located on the Upper Level of the United States Capitol Visitors Center near the door to the House Atrium, included the six individuals who were later identified to be Cindy Fitchett, Michael Curzio, Douglas Sweet, Terry Brown, Bradley Rukstales, and Thomas Gallagher. These six individuals were positioned towards the front of the crowd, close to the Capitol Police Officers who were responding, and to the officer who issued the order to leave. The six individuals, like others in the larger crowd, willfully refused the order to leave. The six individuals, Cindy Fitchett, Michael Curzio, Douglas Sweet, Terry
Brown, Bradley Rukstales, and Thomas Gallagher were removed from the crowd, placed in handcuffs, and arrested.

Subsequently, Cindy Fitchett, Michael Curzio, Douglas Sweet, Terry Brown, Bradley Rukstales, and Thomas Gallagher were all issued Citations to Appear in the District of Columbia Superior Court on a later date.

Just as the Black Lives Matters and Antifa protesters screamed and cursed at Police in DC in 2020, so did these citizens who stand accused of violating the curfew and allegedly cursed law officers doing their jobs.

  1. Cindy Fitchett, of Virginia, was charged on Jan. 7, 2021, with knowingly entering or remaining in any restricted building or grounds without lawful authority; or knowingly, with intent to impede government business or official functions, engaging in disorderly conduct on Capitol grounds; and violent entry and disorderly conduct on Capitol grounds.  
  2. Michael Curzio, of Florida, was charged on Jan. 7, 2021, with knowingly entering or remaining in any restricted building or grounds without lawful authority; or knowingly, with intent to impede government business or official functions, engaging in disorderly conduct on Capitol grounds; and violent entry and disorderly conduct on Capitol grounds. 
  3. Douglas Sweet, of Florida, was charged on Jan. 7, 2021, with knowingly entering or remaining in any restricted building or grounds without lawful authority; or knowingly, with intent to impede government business or official functions, engaging in disorderly conduct on Capitol grounds; and violent entry and disorderly conduct on Capitol grounds. 
  4. Bradley Rukskelas, of Illinois, was charged on Jan. 7, 2021, with knowingly entering or remaining in any restricted building or grounds without lawful authority; or knowingly, with intent to impede government business or official functions, engaging in disorderly conduct on Capitol grounds; and violent entry and disorderly conduct on Capitol grounds. 
  5. Terry Brown, of Pennsylvania, was charged on Jan. 7, 2021, with knowingly entering or remaining in any restricted building or grounds without lawful authority; or knowingly, with intent to impede government business or official functions, engaging in disorderly conduct on Capitol grounds; and violent entry and disorderly conduct on Capitol grounds. 
  6. Thomas Gallagher was charged on Jan. 7, 2021, with knowingly entering or remaining in any restricted building or grounds without lawful authority; or knowingly, with intent to impede government business or official functions, engaging in disorderly conduct on Capitol grounds; and violent entry and disorderly conduct on Capitol grounds. 

In addition, approximately 40 individuals have been arrested and charged in Superior Court with offenses including, but not limited to, unlawful entry, curfew violations, and firearms-related crimes.

The cases are being prosecuted by the U.S Attorney’s Office for the District of Columbia and are being investigated jointly by the FBI; U.S. Bureau of Alcohol, Tobacco, Firearms, and Explosives; United States Marshals Service; U.S. Capitol Police Department; and the Metropolitan Police Department.

Organizer of Provo protest arrested, accused of rioting, making threats

FROM KUTV: John Sullivan is the founder of the civil rights group Insurgence USA and does not align politically with President Donald Trump, but has been in D.C. this week for several planned protests including Wednesday’s rally at the Capitol.

There was a crowd of about, I would say, more than 50,000 people just at the Capitol base trying to get in,” Sullivan said.

Sullivan said at one point he witnessed a protester take a riot shield from an officer, “and he started slamming the riot shield against the cop, took that, threw it down the steps, and threw the officer down the steps as well.”

Sullivan estimates at the peak 10,000 people were inside the Capitol.

Those protesters got really angry and busted through those officers really quickly, and yeah, you could really freely move around, you could go into any room and look out the window, so it was really surreal to see.”

The chaos shows how upset people are, Sullivan said.

“I think history will remember this day as a day America definitely changed forever,” Sullivan said.

Sullivan said he’s hearing the White House and the BLM Monument could be next targets, so he’s staying in D.C. to see what happens before coming back to Utah.

“Protesters weren’t really, like, trying to burn anything down, they weren’t really trying to break anything, their main motive was to make it into the chambers,” Sullivan said.

And in that process, one woman was shot and killed, and Sullivan was standing right next to her when it happened.

“I remember looking into her eyes and seeing the lifelessness and understanding that she was dead,” he said.

Police were no match for the overwhelming amount of people inside.

He’s from Utah and the founder of “Insurgence USA,” which is a group dedicated to “racial justice and police reform.” According to numerous news reports, he has a history of organizing leftist protests and identifies with Black Lives Matter.

I immediately excused myself from that video conference, and convened an emergency meeting immediately of our entire unified command team, including General Gowen, Colonel Jones, our senior staff, our homeland security advisor, and leaders of Maryland State Police and the Maryland National Guard.

“We immediately offered support to the District of Columbia, which submitted a direct request for law enforcement support through the Emergency Management Assistance Compact. 

“I directed Colonel Jones to mobilize our mobile field force of 200 specially-trained Maryland State Police troopers to help provide security for our nation’s Capitol. I also instructed General Gowen to immediately call up our initial response force of the Maryland National Guard.

“they had been spirited off to some undisclosed location—that the U.S. Capitol Police was overwhelmed, that there was no federal law enforcement presence,…the leaders of Congress were pleading with me as the governor of Maryland for assistance from Maryland’s National Guard and State Police.”

“Right in the middle of that meeting with our security team, I got a phone call from House Majority Leader Steny Hoyer, who was calling me saying that he and Speaker Pelosi and Senator Schumer were all together in an undisclosed bunker—they had been spirited off to some undisclosed location—that the U.S. Capitol Police was overwhelmed, that there was no federal law enforcement presence, and that the leaders of Congress were pleading with me as the governor of Maryland for assistance from Maryland’s National Guard and State Police.

“I informed Speaker Hoyer and the other leaders that a force of specially trained riot police equipped to respond to civil disturbances as well as members of allied and local law enforcement agencies were already en route to the Capitol.  

“I also told them that I authorized the mobilization of the Maryland National Guard and that I was ready, willing, and able to immediately deploy them to the Capitol. However, we were repeatedly denied approval to do so. Under federal law, the mayor of the District of Columbia does not have authority over the guard, and we must receive approval from the Secretary of Defense before we’re able to send our Maryland National Guard across the border into the federal city, into the District of Columbia. 

“So we had a little back and forth, trying to get that authorization. In the meantime, we did not hesitate to continue to mobilize and get ready so that if and when we finally got that approval, we could immediately move.

“Approximately an hour and a half later, I got a call on my cell phone from the Secretary of the Army, Ryan McCarthy, who gave us the authority that we needed to be able to move into the city.

“The initial contingent of Maryland National Guard members were the first to arrive in Washington from out of state.

“I just got back from the DC armory, where I had the chance to meet with and thank some of the members of the National Guard for their service on this important mission to protect our nation’s Capitol. I thanked them for their service, and told them that this assault on our democracy cannot stand.

“I just want to assure all Americans that the State of Maryland will do anything and everything we possibly can to continue to secure the core of our nation’s capital, and to ensure the peaceful transition of power.

“Today we are extending the Maryland National Guard’s mission in Washington, D.C., through the inauguration and the end of the month. 

“As part of a coordinated effort with federal and local law enforcement, the Maryland State Police’s mobile field force team provided security support to restore the peace at the U.S. Capitol building last night, and also assisted the Metropolitan Police throughout the night with the enforcement of curfew violations.

“Maryland State Police commanders are in constant communication with D.C. law enforcement officials, and we have assured them that we will continue to provide any further assistance that they require.

“I spoke to Mayor Bowser last night, and offered her Maryland’s full support in the days and the weeks ahead. 

“In addition, Maryland State Police as well as Maryland Capitol Police, some of which you see around here, have increased security around the Maryland State House complex, since there’s been a number of incidents at state capitols and governor’s mansions around the country.

Capitol Police Officer Injured During Capitol Riot, Collapsed and Died

At approximately 9:30 p.m. January 7, 2021, United States Capitol Police Officer Brian D. Sicknick passed away due to injuries sustained while on-duty. 

Officer Sicknick was responding to the riots on Wednesday, January 6, 2021, at the U.S. Capitol and was injured while physically engaging with protesters.  He returned to his division office and collapsed.  He was taken to a local hospital where he succumbed to his injuries.  The death of Officer Sicknick will be investigated by the Metropolitan Police Department’s Homicide Branch, the USCP, and our federal partners. 

Officer Sicknick joined the USCP in July 2008, and most recently served in the Department’s First Responder’s Unit. 

The entire USCP Department expresses its deepest sympathies to Officer Sicknick’s family and friends on their loss, and mourns the loss of a friend and colleague. 

Capitol Police turned down help from FBI, National Guard before siege

FROM THE NEW YORK POST: The US Capitol Police refused to accept help from the FBI and National Guard before President Trump’s supporters stormed the Capitol, according to a report.

The Pentagon offered Sunday to send guardsmen to help secure the perimeter and the Justice Department offered FBI help on Wednesday as the mob arrived, according to The Associated Press. Both offers were rejected.

Instead, despite plenty of warnings of a possible insurrection and ample resources and time to prepare, the Capitol Police planned only for a free speech demonstration. MORE

Capitol Police officer hit in the head by fire extinguisher on life support after DC riots

FROM THE NEW YORK POST: A US Capitol Police officer is on life support after being struck in the head with a fire extinguisher during Wednesday’s riots, a report said.

Four people were fatally injured in the mayhem in Washington, D.C., where masses of Trump supporters easily overtook police to gain entry into the Capitol building.

A source told NewsNation Now that a rioter had assaulted the officer with the fire extinguisher.

Early reports indicated the officer had died, but in a statement to a WUSA 9 reporter, Capitol Police union chair Gus Papathanasiou clarified the cop was still on life support.

Responding to the officer’s injury, Minnesota Rep. Dean Phillips wrote on Twitter, “My heart goes out to the family of the officer and to all who risk their lives every day to protect and serve our communities with dignity and principle.”

EDITORIAL OPINION: There is no doubt that massive election fraud took place in 2020 and a lot of that had to do with the changing of election rules by partisan politicians appointed by governors in six states. The Trump campaign and the GOP could have initiated court challenges last summer when those Covid inspired rules for Mail-in ballots were issued, but they did not.

The President and his attorney both issued statements leading up to the Save America rally that simply was inflammatory and while they have a right to make such statements, they need to take ownership of those words. Equally inflammatory remarks have been issued by Biden and Harris over the past year, with similar riotous results in cities across America. They too need to take ownership of their inflammatory words as well.

The fervent protests surrounding the 2020 US election reached an ugly head Wednesday afternoon — but it had been steadily brewing for weeks and its implications could last for years.

The prospect of a huge gathering in Washington, D.C., was first revealed by President Trump as far back as Dec. 19, as he continued to deny losing the election to Joe Biden.

Aaron Mostofsky, who told the Post Wednesday he’d come to protest a “stolen election,” was holding a police riot shield as a mob of rioters swarmed the building Wednesday.

FBI Seeking Information Related to Riot at the U.S Capitol Building

The FBI is seeking information that will assist in identifying individuals who are actively instigating violence in Washington, D.C. The FBI is accepting tips and digital media depicting rioting and violence in the U.S. Capitol Building and surrounding area in Washington, D.C., on January 6, 2021.

If you have witnessed unlawful violent actions, we urge you to submit any information, photos, or videos that could be relevant at fbi.gov/USCapitol.

Invader of Capitol was killed by Capitol police officer as she stormed House chamber

The DC Police announced that when a crowd attempted to gain entry into the House chamber in the Capitol, that they were confronted by six plainclothes Capitol Police officers at which time one of the officers discharged his weapon and shot the female who later died at a local hospital.

District Police Chief Contee announced at a press conference at about 10:00 pm January 6, 2021, that the Capitol has been secured and the Congress was resuming their special session to confirm the ballots of the Electoral College.
The chief reported the following:
The assistance of police agencies to arrive in the District to clear the Capitol and the grounds were listed as Maryland State Police, New Jersey State Police, Virginia State Police, Fairfax County Police, Montgomery County Police, Arlington County Police, Prince William County Police, Prince Georges County Police and assets of the DC National Guard.

DC POLICE REPORT THESE PERSONS DIED OF MEDICAL EMERGENCIES ON THE CAPITOL GROUNDS DURING THE PROTEST THAT LED TO THE CAPITOL RIOTS:


34 y/o Rosanne Boyland of Kennesaw, GA; 55 y/o Kevin Greeson of Athens, AL; and 50 y/o Benjamin Phillips of Ringtown, PA all suffered medical emergencies.

Statement by Capitol Police Chief Sund

United States Capitol Police (USCP) officers and our law enforcement partners responded valiantly when faced with thousands of individuals involved in violent riotous actions as they stormed the United States Capitol Building.  These individuals actively attacked United States Capitol Police Officers and other uniformed law enforcement officers with metal pipes discharged chemical irritants and took up other weapons against our officers. They were determined to enter the Capitol Building by causing great damage.

As protesters were forcing their way toward the House Chamber where Members of Congress were sheltering in place, a sworn USCP employee discharged their service weapon, striking an adult female.  Medical assistance was rendered immediately, and the female was transported to the hospital where she later succumbed to her injuries.  She has been identified as Ashli Babbitt.

As per the USCP’s policy, the USCP employee has been placed on administrative leave and their police powers have been suspended pending the outcome of a joint Metropolitan Police Department (MPD) and USCP investigation. 

As these other violent events were unfolding across the Capitol Complex, the USCP officers were simultaneously responding to a report of a pipe bomb in the 300 block of First Street, SE, and a second pipe bomb in the 400 block of Canal Street, SE.  A suspicious vehicle was also identified in the 300 block of First Street, SE, at this time.

The USCP Hazardous Materials Response Team determined that both devices were, in fact, hazardous and could cause great harm to public safety.  The devices were disabled and turned over to the FBI for further investigation and analysis. 

The suspicious vehicle was thoroughly investigated by the USCP, FBI, and ATF.  It has been cleared of any hazards.  The USCP arrested the vehicle’s owner along with 13 additional suspects for unlawful entry of the U.S. Capitol.  The USCP is continuing to review surveillance video and open-source material to identify others who may be subject to criminal charges.

14 Police Officers were injured

  • One officer suffered serious injuries when he was attacked and is still hospitalized and undergoing testing.
  • One officer suffered significant facial injuries when he was struck by a projectile.

Pipe bomb distribution was non-partisan

Two pipe bombs have been recovered with one each from the headquarters of the Democratic National Committee and another from the headquarters offices of the Republican National Committee.

Police said that a cooler was recovered from a vehicle with a long gun. The cooler contained Molotov Cocktails.

Update 9:23 p.m. ET: KUSI has identified the identity of the woman shot at the Capitol on Wednesday as Ashli Babbit after speaking with her husband.

The woman is Ashli Babbit, a 14-year veteran, who served four tours with the US Air Force and was a high-level security official throughout her time in service.

Her husband says she was a strong supporter of President Trump and was a great patriot to all who knew her.

Sund was sworn in as the tenth Chief of Police in June 2019.  He joined the United States Capitol Police (USCP) in 2017 as the Assistant Chief of Police and Chief of Operations.  Chief Sund is well known and respected in the law enforcement and academic communities for his senior command and operational experience as well as his specialized education and training. 

Sund served with the Metropolitan Police Department (MPD) in Washington, D.C., for more than 25 years.  He retired from MPD as the Commander of the Special Operations Division, within the Homeland Security Bureau.  In this assignment, then-Commander Sund oversaw a number of specialized units to include the Emergency Response Team; Aviation and Harbor Units; Horse Mounted and Canine Units; Special Events/Dignitary Protection Branch; Major Crash and Commercial Motor Carrier Enforcement; Automated Traffic Enforcement, and the Domestic Security Operations Unit.  During his career, Sund coordinated a number of National Special Security Events (NSSE) by the Department of Homeland Security, to include the 2001, 2005, 2009, and 2013 Presidential Inaugurations.    

Chief Sund is a recognized expert in critical incident management and active shooter preparedness and response.  His experience involves being the on-scene incident commander on the 2009 shooting at the National Holocaust Museum, the 2012 shooting at the Family Research Council, and the 2013 active shooter incident at the Washington Navy Yard.  In addition, he has handled dozens of criminal barricade and hostage situations with an impressive record of zero fatalities. 

Sund has received numerous awards and certifications.  Due to his knowledge and experience, he has been an instructor with the United States Secret Service in the area of major events planning and has taught Incident Command System (ICS) at the George Washington University as an adjunct professor.  Prior to coming to USCP, he worked in the private sector for a nonprofit science, technology, and strategy organization as a director in the area of National Security and Intelligence. 

Chief Sund received his Bachelor of Science and Master of Science degrees from Johns Hopkins University and a Master of Arts in Homeland Security from the Naval Postgraduate School.

Hogan Sends In 200 Maryland State Troopers to Aid U.S. Capitol Police

“All Americans should be outraged by this attack on our nation’s Capitol. This is a heinous and violent assault on the heart of our democracy. I will not stand for this, and neither should any American.

At my direction, the Maryland State Police is sending in troopers to assist the Metropolitan Police Department and the United States Capitol Police. I have instructed the Adjutant General of the Maryland National Guard to call up a rapid response force to support law enforcement and restore order.”

“The people in this Capitol are not your enemy… this is not ok,” he said. “This should be condemned. I’m saddened and disappointed by what I’ve seen.” 

He pointed out that Americans wearing American flags on their uniforms fight our enemies — we don’t fight each other. He called for Florida-style election reforms, but said storming the Capitol is not the way to accomplish those goals.

I JUST SAW COURAGE PERSONIFIED!!  

We were in the middle of debate when the Capitol Police came into the chamber and told us there had been a breach in the Capitol Building.   At first they wanted us to remain in our seats in the House Chamber.  The breach must have gotten worse because they started to evacuate.  Then the mob literally reached the doors of the House Chamber and the Police were short handed and I AM SO PROUD that Rep Tony Gonzalez, Rep Ronny Jackson, Rep Troy Nehls didn’t hesitate!!!  We augmented the Police and stood our ground!  We will never be intimated by any mob, regardless of their motivations.  

The mob reached the actual doors to the House Chamber and there was visible concern on everyone’s faces and yet we stood our ground.  Tony Gonzalez and Troy Nehls were literally on the front lines with myself and Admiral Jackson directly behind them and beside Rep Mark Wayne Mullin (who promised he’d be the last person to leave-standing guard while other members, both Democrats & Republicans were being evacuated to safety) and Ken Buck from CO was there as well.  We broke off furniture to make clubs to defend the US House of Representatives.  

Ronny looked over at me and declared, “I’m not going anywhere!”  Tony and Troy looked back and nodded reassuringly.  I remembered what Tim Grunhard (a center at Notre Dame) would say before a big game at home in South Bend.  So I repeated it, “This IS OUR House! And we’re gonna protect it!!!”  No one flinched.  No one!!!

I serve with heroes.  My Texas GOP colleagues have been my friends and now they are my heroes!!!

We then helped the police barricade the set of doors we were guarding with a large piece of furniture and we had stepped to the side to place it there and that’s when the small pieces of glass went flying.  “SHOTS FIRED!” Someone screamed.  “Rounds fired, rounds fired!!” Shouted another.   Those rounds, if that’s what caused that broken glass would have struck us just seconds before.  

Please pray for a peaceful resolution.  We must condemn any and all violence.  We don’t yet know the facts yet.  Who was responsible, the why etc…Right now I can report only that we are safe and that we’re at an undisclosed location…and so serve with heroes!!!!

There’s been no equivocation about the violence on the part of Republicans.
