Man Indicted For Murder In Fatal Hit-And-Run Work Zone Crash In Wicomico County

(SALISBURY, MD) – Following a grand jury indictment, a Somerset County man has been charged with murder following a fatal hit-and-run crash involving a utility worker earlier this year in Wicomico County.

The Wicomico County State’s Attorney’s Office presented the case to the Wicomico County Grand Jury on May 20, 2024. The Grand Jury returned an indictment against Jamal Scarborough, 27, of Marion Station, Maryland. Scarborough is charged with second-degree murder, first-degree assault, negligent vehicular manslaughter, criminally negligent vehicular manslaughter, failure to return/remain at an accident involving death, failure of driver to render assistance to the injured, driving on a revoked license and related charges. Scarborough was already being held without bail at the Wicomico County Detention Center.

The deceased is identified as Thomas R. Attix, 64, of Dover, Delaware.

Thomas Robert Attix, Jr., age 64 of Dover, Delaware passed away unexpectedly on Tuesday April 2, 2024, in Christiana Hospital in Newark, Delaware because of a tragic and senseless hit-and-run motor vehicle accident while he was working. He was the loving husband of Donna (Gearhart) Attix.

Thomas was born on October 8, 1959, in Dover, Delaware to Thomas Robert Attix, Sr. and Carol (Clegg) Attix. He was the eldest of four children and lived in Dover his whole life.

Thomas was a dedicated and hard-working employee of Voshell Brothers Welding Inc. of Dover, Delaware where he served as a utility and construction worker. He loved life and was a joy to be with. Thomas was passionate about his story telling, making people laugh with his jokes and ensuring everyone had a good time. He especially loved nights out dancing with his beloved Donna after a good home cooked dinner.

Thomas enjoyed hunting, clamming, gardening, raising pigeons, ducks, and chickens. He also enjoyed walking barefoot on a sandy beach.

Besides his wife of 42 1/2 years and parents, Thomas is survived by his son Thomas Robert Attix, III.

Thomas is also survived by his brother; Richard (Koren) Attix, sisters; Mary Attix and Carol (Bobby) Walls.

Additionally, Thomas is survived by his brothers-in-law and their wives; Ronnie and Connie Gearhart, Jack and Pam Gearhart, Jerry and Linda Gearhart, Larry and Cheryl Gearhart and Dave and Barbara Gearhart, sisters-in- law and husbands; Maxine and Rosendo Mendez, Loretta and Jim Hazelton and many aunts, uncles, nieces, nephews, cousins, extended family and friends.

Thomas was preceded in death by his mother and father-in-law; Mary and Earl Gearhart, brother-in-law; Wayne Coverdale, sisters-in-law; Mary Ann Coverdale and Yerma Pisapia.

He was a friend to all and will be greatly missed. He was one in a million and there will never be another guy like him.

Services will be held on Thursday, April 11th, visitation starting at 10:00 am and funeral service at 11:00 am at Faries Funeral Home, 29 South Main Street, Smyrna, DE 19977. Burial will follow in Sharon Hills Memorial Park Cemetery, Dover, Delaware.

SALISBURY, MD—Maryland State Police are investigating a hit-and-run crash and vehicle pursuit that occurred on March 28, 2024, in Wicomico County.

Shortly before 10:25 a.m., an off-duty trooper from the Maryland State Police Salisbury Barrack was driving his marked Department vehicle south on Airport Road adjacent to Salisbury Regional Airport when he stopped at a work zone where a flagging operation was in effect. Workers were allowing northbound traffic to proceed.

According to a preliminary investigation, the driver of a blue Jeep, who was in front of the trooper’s vehicle, swerved into the northbound lane in an attempt to bypass the work zone. The driver of the Jeep swerved back into the southbound lanes to avoid oncoming traffic before driving off the road and into a roadside ditch.

Investigators said the driver of the Jeep, identified as Jamal Patrick Scarborough, 27, (DOB 12/20/1995) of 5352 Tulls Corner Road, Marion Station, Maryland, accelerated his vehicle, ran over the orange casings placed on the road by the utility crew and ran over one of the utility workers, who was on the ground working. The worker, a 64-year-old male, was transported by ambulance to Tidal Health Peninsula Regional Hospital before being flown by private helicopter to Christiana Hospital in Delaware for treatment of his injuries.

The off-duty trooper, along with troopers from the Salisbury Barrack and an additional off-duty trooper, pursued Scarborough briefly through Airport Road, Maryland Route 12, and Nutters Crossing Road before apprehending the suspect on a field near Johnson Road in Salisbury, Maryland.

Scarborough was arrested at the scene and charged by Maryland State Trooper B. Todd. The Maryland State Police Crash Team is leading the investigation. After consulting with the Wicomico County State’s Attorney’s Office, Scarborough was charged with first-degree assault, second-degree assault, causing a life-threatening injury while operating a vehicle in a criminally negligent manner, causing serious injury to a vulnerable individual, attempting to elude police and related offenses.

Scarborough is being held without bond at the Wicomico County Jail. A bond hearing was held by District Court Judge Cathi V. Coates on March 28, 2024 and court records show that a Preliminary Hearing will be held on April 25, 2024.
