Update: Verdict of guilty with Probation Before Judgment, a sentence of ten years in prison with all but three days suspended.

SILVER SPRING, MD. – A professional therapist, David Kupferschmid, with a studio located in the home of an NIH Medical Official in the Forest Glen residential community near the old Walter Reed Hospital, has been charged by the Montgomery County Police with second-degree rape of a client during a massage session.

On October 5, 2020 at 1023 hours, the writer interviewed Victim A at the Family Justice Center, located at 600 Jefferson Plaza, Suite 500, Rockville, Montgomery County, MD 20852. Victim A, whose identity is known to the writer but requests to remain confidential due to fear of reprisal, reported a rape that occurred on July 8, 2020 in the 2700 block of Cassedy Street Silver Spring, Montgomery County, Maryland 20910.
On July 8, 2020, at approximately 1330 hours, Victim A responded to the 2700 block of Cassedy Street Silver Spring, Montgomery County, Maryland 20910 for a scheduled massage with a known acquaintance, David Kupferschmid. Kupferschmid is a therapeutic masseuse and has an in-home massage studio at the above-mentioned location. Victim A walked upstairs to the in-home massage studio and took off his clothing, as directed by Kupferschmid. Victim A laid down on the prepped massage table with a towel wrapped around his waist, as he did not have underwear on. Kupferschmid walked into the room and told Victim A he is “a beautiful man” and “I’ve been wanting to get you on this table for a long time.”
Victim A stated that the massage started off normal, and then things changed. While laying on his stomach, Victim A felt Kupferschmid’s hands massaging towards his butt crack. Victim A felt very uncomfortable and kept readjusting his position and clearing his throat. Kupferschmid stated, “breathe through your butthole.” Victim A then flipped over onto his back and still had the towel covering his genital area. Kupferschmid then reached his hand under Victim A’s towel and grabbed his penis and testicles. Victim A immediately tried to get up from the massage table and Kupferschmid pushed Victim A back down. While grabbing Victim A’s penis and testicles, Kupferschmid stated, “don’t worry, relax, I know.” Kupferschmid then proceeded to insert two fingers into Victim A’s anus. Victim A screamed and Kupferschmid replied, “did I hurt you?”
Shocked and shaking, Victim A was able to get up from the massage table and go into the shower room. Before getting into the shower, Kupferschmid grabbed Victim A’s face and said, “promise me we’re ok.” Victim A then paid Kupferschmid for the massage and left the premise.
On October 5, 2020 at 1427 hours, the writer and Detective Gaines conducted a monitored phone call between Victim A and Kupferschmid at the Family Justice Center. During the monitored phone call, Kupferschmid acknowledged that he was wrong in touching Victim A and that it should not have happened. Kupferschmid apologized numerous times and stated, “I got carried away, I did the wrong thing.” The writer and Detective Gaines ended the monitored phone call at 1449 hours. The writer showed Victim A a picture of Kupferschmid, which he positively identified at 1458 hours.
Based upon the above events, the writer believes that probable cause exists to charge David Kupferschmid with the following:
**RAPE SECOND DEGREE** CR 3-304
**ASSAULT-SEC DEGREE** CR 3-203
All events occurred in Montgomery County, Maryland.

DAVID KUPFERSCHMID, 63, (DOB 01/27/1957) of 2707 CASSEDY ST., SILVER SPRING, MD, 10/10/2020, RAPE SECOND DEGREE, and second-degree assault. Charges were placed by a warrant sworn by Montgomery County Police Officer D. Finamore for an incident that allegedly took place on July 8, 2020. Kupferschmid was incarcerated in the Montgomery County Jail on October 10, 2020.

THIRD-TIME DWI PRIOR OFFENDER ALERT
GERRELL DONTAE FLEET, 36, (DOB 12/25/1983) of 12928 Boggy Trail way, GERMANTOWN, MD., 10/07/2020, DWI – Alcohol while transporting a minor child.
Gerrell Dontae Fleet was charged with DWI-drugs on October 11, 2017 at 2:30 am as he operated a 1998 Honda on Mountain Laurel Lane.
In a plea deal with Montgomery County States Attorney John McCarthy, Fleet’s DWI-drugs and DWI-Alcohol charges were put on the Stet Docket, on May 31, 2018, and Fleet was committed to the Montgomery County Jail.
On October 11, 2014, Gerrell Dontae Fleet was arrested for DWI at 3:06 am by Montgomery County Police Officer Mark Hugi. In a plea deal with the Montgomery County States Attorney John McCarthy on March 10, 2015, Fleet entered a guilty plea to DWI-Alcohol. THE DEAL: Fleet was given a verdict of Probation Before Judgement with no jail time and a fine of $500 with $300 of the fine suspended. The taxpayers of Maryland provided a free attorney for Fleet.
On Nov. 23, 2005, Fleet entered into a plea deal on charges of possession with the intent to distribute marijuana and pleaded guilty while charges of possessing dangerous substances in a school zone were dropped. THE DEAL: Fleet was fined $250.

KEN MICHAEL SCHWARTZ, 56, (DOB 02/03/1964) 6000 Block of OLNEY LAYTONSVILLE RD., GAITHERSBURG, MD, 10/07/2020, DWI – Alcohol.
On February 5, 2019, Ken Michael Schwartz in a plea deal with Montgomery County States Attorney John McCarthy, entered a guilty plea to DWI – Alcohol in Montgomery County District Court and was sentenced to 60 days in jail with 30 days of that sentence suspended.
On July 11, 2017, Montgomery County States Attorney John McCarthy dropped charges of DWI and other traffic offenses involving a motor vehicle crash that had been filed against Ken Michael Schwartz on July 25, 2016, by Montgomery County Police Officer Gary Zalewski.
On June 16, 1993, Ken Michael Schwartz entered a guilty plea to DWI – Alcohol in front of Circuit Court Judge William C. Miller and was sentenced to 60 days in jail.

Wilfrido Daniel Balbuena was arrested for DWI while southbound on Interstate 270 prior to Rt. 28 on July 14, 2018, at 1:02 am by Montgomery County Police Officer John Romack. On November 1, 2018, Montgomery County States Attorney John McCarthy entered into a plea deal. THE DEAL: Balbuena entered a guilty plea to DWI and was sentenced to one year in jail with all the jail time suspended and fined $80.
